Has anyone noticeed....

On CitBank docs the instructions now say the notary is to sign that document. It doesnt say it should be notarized..just signed. I see there is no place to sign and I checked on a Citibank pkg I did one back in September and that was (Notary to sign) was not there.

Any opinions as to why and should I do this. What I am I signing? Am I saying the client has seen it? I would think there should be a place for them to sign and then an acknowledgement.

Hesitant to call before seeing if anyone else has seen this?

So, they're asking you to sign on the page with the instructions. Do they want you to fax it back with the package after the closing? I had something similar with another company where they had a list of instructions and wanted me to initial after each step then sign the bottom stating that I had read everything and done everything they wanted. That was to be faxed back to the company immediately after the signing. (However, they also wanted me to include the tracking number which of course I wouldn't have until I shipped the docs back).

You're probably verifying that you read it

Not sure why they're doing it, but it sounds like they just want some way of confirming that you have seen and hopefully read the instructions. What is in the instructions? Is there a phrase or paragraph that says the notary had read and agrees to follow the instructions? I see pages that the notary has to sign all the time - like the ID verification page you have to fill out in some packages, and some packages have had instruction pages that I have to sign as notary and send back.
If it says you're to sign, and there's no signature line, I just draw one and sign, printing my name and the words "Notary Public" under the drawn line.

Its the typical instruction page. But thats not what they want me to sign. They want the Funding Transmittal signed by the notary..but not by the client. Also there is no place for a signature. I think Im going to call them and ask why.

If you are referring to Citi's fixed rate home equity loans, it's been there for the past couple of years. It is signature of the person taking the acknowledgement-the notary. It is not on instructions for their lines of credit.

I date it, print my name on the left, and sign where it states "signature of person taking acknowledement". I've never had one returned, and I've done many of these.

Called Citi

My page does not have the acknowledgement and they are confused as to why it does not. The line is also a HELOC. They said that is for the notary to confirm the payoff.

My take away is that the title company needs to do that because I have no way of confirming funds for a payoff. I think maybe other notaries may need to question that one. You may be signing off on something a settlement agent should be signing.

I do this for the law firm when representing the borrower or lender. NEVER EVER as a notary public or signing agent.

To confirm a payoff you need the borrower's permission, their social security #s, their loan #, and lender's telephone number to call (plus a nice cup of coffee while you go through various automated menus and hold muzak). Most lender's now charge a $35 fax fee to get written confirmation within 24 hours, which means you also need to have the confirmation sent to your personal fax, include it in the return package or fax it to Citi upon receipt. The deal killer: Confirmation that Citi will reimburse you the fax confirmation fee and pay for YOUR TIME to do this. Certainly saves the settlement or escrow agent time and money.

Many states prohibit this. Best practice is to use "Signing Agent" as your title if you are signing something without performing a notary act.
