Mortgage company not above writing rubber checks
I was hired directly through mortgage company a couple of weeks ago. My check was included with the package -- pretty nice (since I didn't ask for it upfront), until yesterday when my bank returned it for NSF.

I would first contact the title company, all of their funds are suppose to be guaranteed funds. If they dont respond, I would contact the governing body for title companies (in Texas it is the State Board of Insurance) and advise them of the NSF.

I e-mailed mortgage company last night -- as yet, there is no response although it is only 8:15 a.m. here. Title company is local, so I'm sure I will be visiting them today and walking out with a check, plus bank costs.

Don't count on getting paid by the title company. I had a similar situation (not NSF but just not being paid) when I was hired directly by the lender. Title company did not hire me, so they said they are not be responsible for payment. The lender has the contractual obligation for payment and the fees were not shown on the HUD. Title has nothing to do with it.

Actually, Paul I just contacted title and spoke with the escrow officer on the phone. While talking with me, she e-mailed mortgage cc'ing me and giving them the option of contacting me and settling up with check and bank charges, or that they will pay me directly and will go after mortgage for reimbursement. So it sounds promising.
