EFS
I am getting emails from people I don't know asking about EFS, and if I have outstanding invoices. I have a couple outstanding that I will not see payment for and I have accepted that. I have read the board since it was posted about EFS and know about the closing of EFS and the chargebacks. Don't understand why they are emailing me, or where they got my email address. I have no more information about EFS than they do.

I got the same email, Janie. He got our email address from a broadcast email Karen Held sent us at one time. He is just trying to help himself, and us into finding a way to get paid for the work we did w/o compensation, and for the UPS chargebacks that EFS is not paying for.

Question for ATTORNEYS re: EFS
If we get a judgement against them, will we be able to collect if they file bankruptcy? Will acquiring a judgement be of any value?

If you have obtained a judgment, you can indicate that on your proof of claim. Under the doctrine of Res Judicata it will not be necessary for you to relitigate it in the bankruptcy court. However, the big question is ...Are you a secured or an unsecured creditor. If you have a judgment alone...you are an unsecured creditor. If you have recorded a judgment lien which was not discharged as a preferential transfer you are a secured creditor. In a bankruptcy the secured creditors get paid before the unsecured creditors in the order of their priorities. After the secured creditors get paid the unsecured creditors get paid. However, they are paid on a pro rata basis to the extent that there are funds available. Regardless of the size of the unsecured creditors' claims the remaining assets are devided equally among them.

A Perfect Example of Why to Use BCC
I've complained to EFS several times about not using the BCC on emails. It is a major pet peeve of mine. Even my personal email is now flooded with spam (and yes, I use junk filters!) because friends also have not used this common courtesy.
Whenever an email is sent to more than one person, unless it is meant to show differently, a BCC should always be used.
I too feel like my business email has turned into an open forum compliments of EFS. I never want to take a loss on a job completed, but that is built into my business structure. This is a great example of why those in this industry need to charge accordingly and not take the low ball jobs. Unfortunately, it is a real part of doing business. Especially right now with businesses closing their doors all around us.
