Funny wording on a Quit Claim...

I'm printing docs and came acrossed this wording on a QCD, conveying property from 'sole & separate' to 'joint tenants'.

It says: "The Grantor, [Jane A Doe], as her sole and separate property, for and in consideration of love and affection, conveys and quit claims to [Jane A Doe and John A Doe], wife and husband....

I've never seen it worded that way. How warm and fuzzy...

Wording used on transfers between spouses to avoid having to pay any transfer tax/documentary tax/conveyance tax (whatever it's called in WA) - if they put a consideration in there (usually $100 or more) there's a conveyance tax due the city/county and sometimes the state.

Did a few with that wording way back when I first started as a legal secretary...that's the only reason I know about it - more recent form was "$1.00 and other valuable considerations but less than $100.00"...

Can be used on ANY Quit-Claim Deed between any parties where there is no consideration (payment made)...not just between spouses.

I thought that too. Just got back from the signing, and the borrowers had only been married for a year, and they thought it was GREAT! Actually stopped and did the ~gaze~ into eachothers eyes...

Yes, until the divorce...hopefully that never happens. Then, I wonder if it will be 'for and in consideration of hatred and despise'?
