Legal or not?
I did a signing on 9/26 and when I faxed it back, it was discovered that I had a non-borrowing spouse sign, when he wasn't actually on the deed...my mistake. So, I returned and had the document re-signed on the 27th. The company is now asking me to return and have it signed with a date of the 26th. I thought this was illegal and they are telling me that it is not illegal. Who's right here?

I believe that backdating is illegal in all 50 states. It certainly is here in PA. Consult your notary handbook for CA. You know what it will tell you. Good luck.

Not only that, it's a Penal Code Felony to falsify any information in any notary certificate! FYI - It's also a misdemeanor for them to ask a notary to perform illegally.

Exactly. Even if it's your mistake, it's still illegal.
Of course trying to convince these companies of that fact is virtually impossible, they think that since you were out there that day, it's no problem to have something resigned and notarized for the original date.
