How can signing edocs and faxed docs be legal in the state of virgini, if you are suppose to witness the signing?

I didn't understand your question. You weren't really suggesting that someone had asked you to sign and stamp a doc that was emailed to you, were you? I know in VA there is no test to take to become a notary but it is a requirement that you read the handbook and understand it. If you have and you do, then this question would never have been asked, that's why you got some of the smart answers from posters on this board.

Legal because as of July ! 2007 you need to use a notary seal that you can see when faxed, either take the old seal and use carbon paper or ink your embossed seal (messy) or up grade to the pre inked stamp. Acorn supply for 15.00 dollars.

The general idea is that the unsigned documents faxed or emailed to the notary, or the notary downloads them. The notary takes them to the signer, who signs them. The notary notarizes any pages documents that need it. The signed documents are sent by mail or delivery service to an appropriate destination.

Some states do not allow notaries to do this for real estate transactions unless they are also attorneys, or have some other license (such as title producer). I have no idea what Virginia allows.

Requirements

Make sure you have a fast printer, lots of extra ink, extra printing drums, extra reams of paper, fast internet connection, and tell the borrower that you might be late because the doucments may show up after the appointment time. If you are going buy a printer special you may as well pay extra for the double trays.

No doubt about it. Anyone who is entering this field now really, really ought to buy a printer that can automagically choose between letter size and legal size paper based on the PDF file. Otherwise the newbie will regret not having done so.

I've never had a printer with two paper trays and I've been doing this for over 4 years. I just print all mixed packages on letter size, it's never once been an issue in over 3000 signings.

Cali I think you meant print on all legal

And I think the poster was alluding to the fact that legal paper prices have gone way up, and with the tightening market, it makes sense to print on letter, because of cost, when possible. I still print the borrowers copies on my 3330 on legal, and am about to install a 1200 SE in my car for mobile printing on all legal. JMHO

I also print their copy on "toner saver." I wouldn't recommend this printing method until you have done several hundred loans.

My method can save a very experienced loan signer a lot of money on paper & toner.

A dual tray printer is a very good choice if your buying a new printer.

I bought 2 Brother MFC 8860DN and I will go back to HP because, while the Brothers print at 30 pages per minute, they also require a DRUM to place the toner cartridge in.

After 25,000 pages you have to buy a new DRUM or at least my printers left black print smudges on the edges of the documents I printed and turning back the counter didn't solve my problem.

It's HP for me from now on!

We really don't know -

if this person is a commissioned notary. You don't have to be a notary to participate on this board. If they aren't, they're seriously wasting their time.

Because you're not just a notary doing signings. As the Signing Agent you receive the documents electronically, either through attachment to e-mail, or link for a download, or via fax (which is extremely rare these days). Once you've printed docs (usually 2 sets), you meet with the borrowers, verify their ID, have the sign the documents where necessary and notarized the documents that the borrower's sign that need it.

Just curious, why would you think it illegal to receive/print the documents?

For all who have smart answers the only reason I aksed that question was because I had a new sigining company send me a document that already had a signature on it!!!!!!!!!!!! Maybe I should have reworded my question, but you'll need to grow up because we are suppose to all be notaries and help each other out if there are questions. Like I said earlier thanks for nothing!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Ebony as Sylvia pointed out, it definitely makes a difference in the quality of replies, if the post has as much information as possible. Such as:

"The SS faxed me an already signed document asking me to notarize it." etc., etc., However, to be honest, this type of question may also garner you some "smart" answers because ALL notaries must know first and foremost that the answer is a resounding "NO," why, because A) the signer has to personally appear before the notary at the time of notarization; B) provide proper identification; C) there should be an original signature on the document for you to notarize, along with any other state specific requirements.

All of this gets explained to the company, and usually they don't like it when you tell them it's illegal to do as they requested. Here in CA, I quote Section 8225; It's illegal to ask a notary to perform illegally Smile It's a misdemeanor.

You are absolutely right, I have helped out many notaries, especially new ones for years, I don't feel someone asking for a little help with information should be put down. Sometimes people need to feel superior. Ignore the negative and go with with the positive!

Kate - They wouldn't Smile I make it very plain what "e-docs/faxed docs" are and that they will ALWAYS print two sets unless they've received instructions to only print one set, etc.
