There was another NSA at my 9am closing.

I get to the closing, there is another NSA there. Seems the borrower had 2 CW loans, and it was put through 2 different TC's. The other NSA got there before me so she did her thing. She handed the borrower the entire pile of papers and said, sign, date and initial where needed. When the borrower was done, the NSA went through the pile, and handed the borrower back about 10 different docs for initials, dates or signature.

It was my turn. While I started, the other NSA sat there and called 3 different numbers to say the closing was completed and then listened to me. My closing went ....this is your note, your loan amount is, interest rate is, while pointing out the features she needs to look at. I tell her to initial page 1, sign page 2, etc. I tell her the title of the doc, and a brief synopsis if warranted. The other NSA starts to leave, and asks me how I can get away with explaining everything. I replied, I'm not giving legal advice, I'm just pointing out what anyone can see are the important things on loan documents. (This is your payment with escrows). She doesn't think it's right. I explain that I do know the difference between UPL and doing my job correctly.

Once she left, the BO stated that she could not wait for the other NSA to leave. That in all her years, no one had ever handed her a pile of docs and said sign, without going over at least a few details. I now know who is doing the low paying jobs in this area! BO said she was going to call CW and complain about the other NSA and give me a rave review.

How can a borrower sign docs that they are not aware or willing to sign unless they are explained (check your handbook) ? I have always explained docs to the borrower unless they say that they are a RE agent or LO and do not want them explained. We are only reading from a set of docs where the info is in black & white. Good Job - you should get a rave review!

I had that happen once except I was the first Notary. When the 2nd notary arrived, the Borrower asked what the terms of the loan was that she had and the notary had no idea. I asked her if she had the Note and she said there was no Note in the package. She asked me to go ahead and go through the package with the Borrower as she had no idea what to do. We quickly went through her package for the terms and the Borrower decided they didn't want the loan she brought with her and refused to sign.

I went ahead and continued with my signing and she asked if she could stay to see how it was done. She stayed for awhile then left. The Borrower's were so glad I was there to explain (or shall I say point out) the terms of the loans.

I think those "other" notaries are really rude.

They are so rude to sit there and get free training from you guys. And the notary who said, "How do you get away with explaining the docs?" Wow, how does she get away with not explaining them?

Once in a while I get someone who is not an LO, and they insist on my handing them all the docs in a lump. Whenever I do that, they start sorting through them, mixing them up, missing signatures, reading the servicing agreement, etc. They think they are so smart. Maybe they can do brain surgery, but they don't know loan docs. It goes so much more quickly when I review the terms, then give them one at a time with a brief explaination.

Actually Lisa did not "explain" the docs, she identified them pointing out the key features, which is what any good NSA will do.

What she did and what the other NSA did shows the difference between a professional and a point and sign notary.

What can the BO do when - -

they get a notary who has no idea? Or maybe the notary does but slops it up? If the BO wants the loan, they have to sign. One lender (I wish I could name) insists on the LO being there for "moral support or something"? They have no idea what the docs are - "I've never seen that one before !"

I don't care whether the LO is there or who the borrower is - there is no way I'm going to hand over a pile of docs to a borrower to sign. I will quickly pass them over one at a time, but I'm not relinquishing control and risking getting anything messed up. And if they have a firm grip on the docs (which has been the case several times), I'll find a nice way to get them back. I'm going to be responsible for what happens to them in the end.

The closest I ever came to letting go was with a former RE agent who said she was now an NSA and knew what to do. (These were from a lender whose docs tend to be very different from the norm.) She was such a snip about it that I let her dig herself into a hole and I handed them over one at a time without comment until I checked them at the end. Naturally, I found tons of places that she missed. I held my tongue, but was smiling inside each time I had to correct her! ;>Wink

BTW, as for those other notaries sticking around to watch, I'm not sure exactly how I would do it, but I'd sure try to politely excuse them from the signing before continuing, and perhaps even be pretty direct about it, if necessary. After all, whatever I walked in with is none of their business. That's the height of chutzpah, if you ask me! I think it's just as inappropriate as taking a ride-along.

This is happening to me a lot lately!! And all with Countrywides! 2 of them the other notary was the same I think she has a connection to someone at Countrywide and whenever a Countrywide comes across her friends desk she assigns it to her, regardless of what the title company title co did . . this is a hunch, but the coincidences are strange. The 3rd one I am not sure who did it but I was on my way home to print the documents when i called the borrower and they said another notary already called them, I went home and lo and behold no docs. The title company called me to see if I made it to the signing and I told them the story and they couldn't understand it either but from what I heard from 1 of the title companies is that sometimes Countrywide people give the assignments to their "friends" but they are not supposed to do it . . well, they are doing it! And so far I have lost 3 decent paying appointments due to this.

thx for the heads up;just got a call to do a countrywide. .

they may not sign so waiting for call back but if the title co calls back, i can ask if i'm the ONLY notary assigned.

This could get confusing.......You may want to be CassiCA as your name, just to try to avoid confusion. Of course that's just a suggestion. Smile
