sorry slipped had a notary witness aloan for me in pa and notary did not give me or my husband an oath or affirmation and did not have us sign a journal which is required in PA. She walked in with the pkg and her stamp nothing else. I didn't say anything to my LO for fear of my loan not going through

I would do as you did and say nothing. If they find an error, she will have to correct it. Someone will catch her on her oversights eventually. I'm sure she's not the only one.

I'm curious, why would your loan not go through if you told the LO? Most LO's could care less as long as they get their commission. Heck, most LO's will tell a notary a library card is acceptable ID.

An oath or affirmation is required for affidavits (jurats) and a verbal acknowledgment for acknowledgments. Both are routinely ignored by many notaries. Signing a Notary Public's register is not required in Pa. I suspect that your Notary's omission will have no bearing on whether your loan is funded. Good luck.

PA does require that you maintain a register.

The Notary Public Law. Act No. 373 of 1953, as amended by Act 151 of 2002, effective July 1, 2003.

Section 15: "Every notary public must keep and maintain custody and control of an accurate chronological register of all official acts".

right

we must keep one but there is no requirement that our signers sign it or even see it. No one ever sees mine - it's in my computer.

Sue, I was just getting ready...

...to give my considered opinion when you just replied in the concise manner one has come to expect. Wink Your answer does bring a question to my mind. In MO we're required to keep a sequential journal in a hardbound paper register & that was true even prior to MO Notary law changes in 2004 requiring the signature of the document signer. Does PA allow you the leeway to keep it on your computer? They evidently must or you wouldn't be doing it, but I thought I'd ask since we're on this topic. Is there a particular software program or format in Excel you have to use?

Since PA now allows E-notarizations, they also now allow computerized journals. I was told by the state that once you start with the CJ you need to stay with it! They do not want you jumping back and forth from written to CJ, because the journal must be in chronological order.

How about being prepared, as in having extra ack's, jurats, pens, notepad, stapler, clips, fingerprinter, etc. etc. We just refinanced some income property a few months ago. The LO emailed the docs to me and I furnished my own notary. This notary came with only his journal and stamp, nothing else. I had to supply ack's as what was in the doc packet were not condusive to CA notary law. I'm assuming this is how this notary conducts most of his signings. I even had to supply the inker for the FP. IMO, it was just very unprofessional.

I cannot think of one time ever that needed an extra ack - if it's not PA compliant, I put it upside down in my package and stamp the doc with an ack stamp when I review my package - same with a jurat - I use a stamp. When I know ahead of time (such as World Savings) I type it up prior to going. Again, I have never used a stapler or clips at the table. We don't fingerprint in PA. I also don't take notes at the table - if I would need to jot something down, it would go on my confirmation sheet. Just not sure what this lady was expecting.

I am speaking more in terms of CA, but you do state that if it is not PA compliant you use an ack stamp an/or jurat stamp. Doesn't sound like this notary had these back-ups. I use a stapler and/or clips for the voided checks so they won't get lost in the shuffle. I use "stickies" for the borrower to write down any inaccuracies as in the 1003 and have them sign and stick on the inaccuracy. I actually have the notepads for the borrowers to write down any questions they may have for their LO during the signing as we all know many LO's are not available at the time of the signing. And I always have pens, lots of pens.
