How about this one

Go to local title company to close a loan for a local older couple who is buying a home 1 1/2 hours away. They financed with the local bank in the town where they were moving. Their real estate agent( from this town) was to bring docs from the bank (Deed, Note). The Deed was not the standard format but was a Land Sale/Deed of Trust. When I looked at the signature page , the couple had already signed, the date was stamped and the notary in the other county signed off. I asked them if they signed this Deed in this town 1 1/2 hours away this day. They said no that they had signed it 3 or 4 days previous and I looked at the RE agent and he was grinning ear to ear. I let them know something improper had occured here. Also the note came as a borrowers copy. What are the legal ramifications of this kind of post dating?

Deed was stamped 04/28/08 but was signed by the borrowers John Doe and Jane Doe 3 or 4 days previous and notarized by the other notary in the other county. And they not did not sign the note at this closing. The owner of the title company called the bank and wanted to know why only a borrowers copy of the note was sent with the package. Apparantly they had also signed it at the bank the same day they signed the Deed. Signed one day, post dated for the actual closing date. I don't think the couple knew what had occurred because the date was stamped, not handwritten in.

Silly me Linda, I thought it was my job to notarize the Deed but the other notary in another county did it and post dated it with yesterdays date.
