SPEEDY NOTARY IN LOS ANGELES

I GOT A CALL FROM DORIT AND SPEEDY NOTARY TO DO A SIGNING. SHE REQUESTED THAT THE 1003 BE BACK BACK DATED TO 3/24/08 AND THEN THE REST THE DATE OF THE SIGNING. I HAVE NEVER BEEN ASKED TO DO THIS AND I DON'T BELIEVE IT IS LEGAL. CAN SOMEONE TELL ME OTHERWISE?

The borrower dates the application and I believe

if it's like most they are wanting a wet signature on the initial application. I bet you'll also find another 1003 to be dated the signing date.

I would tell the borrower what they requested. We, as Notaries, don't care what dates are on the docs as long as the Notarized docs have the correct date, as well as the NRTC, then we have done what we need to do. If the borrower wants to date the 1003 earlier, that's up to them.

PLease don't type in all caps.

I Did advise the client of what they wanted done and he did as they requested. I had nothing to do with the dates. I have client fill them in but I guess he didn't do it correctly and now she is quite upset. I appolggized and advised her this is the first time I have EVER been asked to do this and if it was done incorrectly I take responsability and do not expect any payment. I am just not use to someone asking this of me.

In this case this 1003 is an application doc, and to be put in the file for compliance reasons.
you can either have the borrower date as requested of have them sign and do not date and let it be dated in office.

I probably should have had him just not date and send back blank. So I guess I take full responsability. I just didn't want to date and advised the client to date.

i also don't care what date is on the docs that need the...

signatures notarized.....i only care what date is in my notary block and that is the date that the affiants stand before me and acknowledge or swear....the notary block is not a part of the document,....it is a document unto its self........

what ever the outcome, I have advised Speedy Notary that I do not expect payment and if recieved will send back. I just hope doesn' t cause too much headache for them since client dated incorrectly and I didn't do it as asked since I believed it was not correct for me to date.

I have worked with Dorit for some time now and she never will ask you to do something illegal.All she asks is for the initial loan app's be signed with the date that they run the credit report.

you are being foolish.....if you completed the signing you..

are entitled to your fee......quit worrying over the 1003....it just goes in the file and represents the borrowers info at the start of the loan process......YOU DID NOTHING WRONG.. yes i am yelling it so you hear me......

I would not use the word foolish, its an easy fix so dont beat yourself up over it.
You can email or fax it to the borrower and ask them to sign and dont date or sign and date.

No big deal

Tell the borrowers what the SS wants, they will date it that way if they are OK with it, which should not matter to you in the least. You date your ACK's, Jurats, etc, properly, following the law. Done deal. Just IMO.

I processed loans for 15 years and those 1003's and sometimes other disclosures are their "upfront" disclosures. They are the disclosures that are supposed to be sent when the borrower first applies for the loan.
They usually just have you leave the date space blank, which is what I prefer to do than backdating. They should not have a problem with you leaving them blank though.

Some times I've seen them with the previous date already filled in, sometimes typed, sometimes just handwritten, sometimes the request is to not date at all. While it's true that these preliminary docs should have been sent earlier, signed and returned, we know it's not uncommon for the borrowers to not follow through. We have no way of knowing if that's the case or if they were just never sent. Regardless, I feel it's not something for me to be concerned with. I just let the borrower know what's been requested. [BTW, I'm assuming we're talking about the date next to the signature, not the actual document date.]

Well, I e-mailed Dorit and basically apologized and told her in the 2500+ signings I have done this is the first time EVER there has been an error and that she doesn't have to pay. She made me feel like shit so that is the least I can do with her hanging up the phone on me etc.....

oh Well.............

let me tell you guys, after the way she acted towards me I feel like shXX! I haven't had issues ever before and now since the phone conversation with her I feel horrible.

Don't let anyone make you feel that way. I personally would not work for someone that has the nerve to hang up on someone. Remember you are an independant contractor and you get to choose who you work with. You are the CEO of your company. That is the beauty of being self-employed.

Nazanin - It's never a good feeling when we make a boo-boo. Take it as a learning experience and move on - there's nothing you can do about the way the SS acted. SS should remain professional at all times, just as the notary should.

Since this was not a critical doc, instead of forfeiting my entire fee I would have offered to go back ASAP and have it re-signed and dated how they wanted it (at no additional charge).

It is common to have the broker docs (1003, etc.) dated back to the original date of application. It is not unusual & it is not illegal. This is not "backdating" as that would apply to the loan docs. Sometimes package instructions will say "do not date broker docs".
