Back dating question
I know of a notary who is going to back date docs tonight and want to know if anyone has ever filed a complaint against another notary for this? Is this an easy one to prove to the state if you know the notaries name and borrowers name? I guess the real question is, how easy is this to prove that it has happened?

If it is a loan, Look it up at the register of deeds and confirm it that way. Then turn the whole mess over to the SOS in your state. Hopefully you can document in some way that you were asked to backdate. Perhaps a call now to the SOS explainging your suspisions

If they sent edocs after the date put on the docs that would certainly prove backdating. Reporting bad notaries is the only way to get rid of them.

Evidently Steve is not doing the backdating, therefore, docs not coming to him. Therein lies the proof, unless Steve was asked to backdate and he refused, but most likely that was verbal, obfuscating further. Would need singing instructions stating docs date sensitive, then something to tie today's date to those instructions and date on docs. Not so easy to prove, IMHO, unless you just ask the BO and they admit they were asked to backdate, etc.

I've turned a notary in. I had written proof, she denied it, and the borrower would not admit it because his rate lock had expired and rates had gone up. SOS did nothing.

Maybe so, but just wait until that B wants out of the deal for some reason and throws the backdating notary under the bus. And SS, TC, Lender all can throw Notary under the bus.

Best to mind your own business.
Lets say the state does pay attention to your complaint and then it is up to you to prove this. Who do you plan on calling as your proof? The borrower who has nothing to gain by helping you and possibly has something to lose, he's a no-go. The TC/SS? Yeah they are going to help you. The notary who supposedly did this? He/she will say prove it and you'll be left hanging out to dry.
Let it go, step outside suck up the sunshine and live your life.

Shame on them! We hear of notaries who do it, and I'm not sure if some don't know it's illegal. The notary could be reported to the SOS for misconduct. I guess you have to decide if it's worth your time.

FYI, my profile has been active for as long as yours has and I have been in business as long as you, but I see you still are one of those!!!. Guess you have backdated numerous loans in your times. If you care, it is a closing that I did on Friday, and then it was to be redone yesterday but docs didnt arrive and the company asked me to backdate, but they got someone else to do it after I refused even though the borrower wanted me and was aware of the situation. Dont worry, I have had closings in your area, but used someone else cause of your attitude, oh well....

A few facts Steve:
Back in April your profile disappeared for I don't know how long; there was lots of controversy about you having mulitiple ID's, all basic, thereby bumping at least 4 other notaries from the first 20 listed. A bit unfair if you ask me.
The last time someone posted here about an 'odd happening' he got caught in a lie, left for a while after rolling up his tent, only to return a while later to make a nuisance of himself. If your situation is as you say, well, fine. Like you, I do not backdate, never have, don't see the need to begin now. As for my attitude, I don't think that we have ever tangled, or tangoed for that matter, so my attitude isn't a cause in your decision to use another in my area. No love lost for sure...sorry I hurt your feelings.

Steve, before I realized you were a SS owner, I wondered, "Is this guy trying to figure out if he can get by with it or not? Or if one of his notaries can if he is a signing service owner?"
That's the bain and curse of being a mother to boys.
It makes you think about the question behind the question.
For instance, when a boy asks his mother what she did all day, he isn't really interested in Mom's activities...he's just trying to figure out if Mom saw him cruising around with his friends while he was supposed to be in school. He saw her pulling out of Wal-Mart and wonders if she saw him. THAT'S the question behind the question.
Not saying that this is what you are asking questions for, but I have a very strong BS Detector and I'm not getting the vibe your question intended.

If I knew someone were about to backdate and if I wanted to report the act to the SoS...it wouldn't make a tinker's damn to me what NR members thought.
However, if I wanted to get by with backdating...I think there's plenty of evidence that you can in most instances according to this board.
BUT, as I was talking to a real estate/mortgage lawyer yesterday and discussing how the industry is folding in on itself we both agreed that front-dating or back-dating could be a disaster at this point in time as never before if a signer became disgruntled and wanted to wreak havoc in an attempt to avoiid obligations. It would be a bad decision to do it, IMHO.

Well, you are another one of those. Passing judgement without knowing the facts, not surprising coming from you!!! I gave the facts, have no reason not to, just not listing the company that hired me. Again I will say I have been a notary and closer for almost 8 years with thousands of loans closed without incident and a signing service for the last 2 years with no complaints, so know your facts before you jump, cause your not always right...
