Limited Power of Attorney

Hello every one!
I have a limited power of attorney form with an old ack wording, should I just cross it off and attach a loose form.

Second question about the same form : )

I am using two credible witness since the principal is in jail and has no ID, do I put the credible witness names on the POA form and also on my journal??

Both your credible witnesses must sign your journal...does your POA ask for witnesses? You may need witnesses on the POA. Also, I would cross out the old ack wording and attach a loose cert. Is there room for the new ack stamp? I'd use that instead, if you have it...but an attached loose certificate is appropriate...I also believe you are going to need to get fingerprints now on POA's...double check your handbook, but I think so...I hope this helps...have a most wonderful rest of afternoon

oh...and one more thing...if the person is in jail, his wristband or JAIL ISSUED i.d. is appropriate...

Wristbands are NOT acceptable forms of ID in CA.....ONLY the ID card issued by the CA
Department of Corrections.

Excellent clarification, LTK, and you are correct about the witnesses, that is why I only put "witnesses" and not "credible" witnesses when stating that fact, but I can see where it seemed confusing.

And, yes, it is ID CARD, not wristband...

Credible witnesses have nothing to do with documents. Their ONLY purpose is to identify the signer. They are to sign the Notary's journal and present an acceptable form of ID. Credible witnesses cannot be named in a document, nor can they have a financial interest. If you are referring to regular witnesses, for California POA's it's either have it notarized OR have regular witnesses sign the witness section but not both.
