Okay - I'm confused...
"she wanted me to notarize the one for her mother who not only was not present but in a nursing home a couple of towns away. Apparently the mother is an invalid who has dementia.
I called the Secretary of State and they said the lady had to contact the attorney who arranged her conservatorship over her mother's affairs "
Who told you there was a conservatorship in place? If there is one in place and she was signing as Conservatrix, why couldn't you notarize her signature (minus the capacity in your certificate, of course)...just because the mother has dementia doesn't automatically create a conservatorship...
Or was the doc already signed by the mother - if that's the case we know the answer - you can't do it without the mother present...
Sorry...your post confused me a bit...must be the heat!!
