Quitclaim - New Regs
I have a notary license that I rarely use. I've been asked by my manager at work to notarize a quitclaim document and I was wondering, with the new regs that came out in Jan (?) 08, do I need any additional paperwork that I didn't need before. I'm not earning money from this or anything, I'm just doing it as a favor and want to make sure I do it correctly. Thanks

Here is the CA SOS handbook (are you in CA?)

You could refer it to someone who is working professionally in your area to do it...but that would cost the signer and not be free. Boo. They want a favor, I know.
You need to actually read your handbook IMHO before even doing a freebie. The govt. doesn't care here in Texas whether we charge or not...they prefer we do it correctly no matter how much we get paid.

Hi Brenda, thanks, that's why I'm here to learn, even though I'm not getting paid. I will read my California Regs, was hoping for a little short cut, my bad.

Rita, there have been some significant changes since the first of this year. The first thing you need to look for is to make sure you have the correct verbiage on the notary certificate. The wording requirements have changed. Also, you are no longer allowed to use personal knowledge for identifying someone. Even if you've known your manager for 30 years, you still have to record proper ID for him/her or every document you notarize.
(BTW, the easiest place on the SOS website you were gien the link to is the notary newsletter. ALL the changes are spelled out there, including some others you should be aware of that may not apply in this current situation.)
Also, kudos to you for checking and wanting to be sure to do it right!! All too many people just assume they know it already and never bother to check or make sure their information is current.

Thanks Janet, just what I was looking for. It's hard to get through the regs sometimes. Kind of aggravates my headaches.
I feel like a dummy for asking but which certificate are you speaking of when you say "correct verbiage on the notary certificate".
I knew about the ID thing, read about it earlier this year. I'm the cautious type. I've always done that anyway.
Thanks again so much Janet.
