FLAGSHIP TITLE SERVICES
Has anyone else done a signing for Flagship Title services in Virginia??They have not paid me and it has been 10 months, and they will not get back to me.

How did you let it get so far? What action have you taken to get paid, and what has been the response on their part? Fill in the gaps for us.
Most signing agents would have taken some kind of legal action a long time ago.
Have you sent a demand for payment letter? What did they do about it?

I don't mean to sound harsh, but it sounds like you're taking the passive approach -- waiting for something to happen. Make it happen!

I have. I have emailed, I have faxed, I have called several times to only get the runaround. Now, this morning, I have a disconnected number. I also havnt been paid from dynamic solutions. I have done everything right, and these loans have closed and I have not recieved my fees, someone has , I bet! what recourse do I have?? I almost want to have payment up front since some of these companies are not honest.

I have done one signing for Flagship and it took two months to get a response from them, they don't return phone calls, and when they do they give you the run-around for sure! I almost got burned from Dynamic, but after seeing the negative posts I got onto them straight away and contacted the title company that hired them. That's the only way I got paid from Dynamic and they were pissed I went through a third party. After all that they shorted me $5! Why?! They never answered that question! I've received messages from Dynamic to do other signings in VA, but I won't return their call.

These are the steps you take when a company is only slightly late in paying you - 30-45 days late....10 months? You have not been very aggressive in collecting your money, but here's what I'd do....
First off, get a copy of the recorded document to prove your loan funded (lots of egg on your face if the loan rescinded and their policy is no pay on rescissions). Check the procedure in your state for small claims actions and, if possible, draft a complaint...
Now, you can send a demand letter to the title company with a copy of your confirmation and a copy of your draft complaint and give them a drop dead date that you receive your payment or you'll file the small claims action. Send it via certifed mail return receipt requested AND regular mail; OR
You can file a written complaint with the state agency regulating title companies in Virginia and request their assistance. Set out the situation in very concise, factual terms and enclose a copy of your confirmation showing promised payment (this would be *my* method of choice).
Whichever route you choose, send a copy to the title company and, if you wish, to the lender - and anyone else you think can light a fire under them and get you paid. Just make sure before you do all this that you are RIGHT...if there's any reason at all they can use as their reason for not paying you (notary error, loan rescinded, loan wasn't signed, etc.) you may be banging your head against the wall.

Thank you Cari for your time writing a process for collections. I'm a new notary, and new to business in general. Only since the economy crashed have I had trouble getting paid. And now I know how to get started collecting my $550 owed to me.
I live very rural: 50 miles from our two large towns..1 south, 1 north, each only 20,00 population. So I can't just casually run to the courthouse or anywhere else. It's a day long event.

Unless required by your state to serve notice prior to instituting suit, I wuoldn't bother with this step. They know they owe you. I have no idea how long people have to claim a certified letter but it's got to be at least a week ... plus the mailing time ... plus whatever time frame you give them ... that's probably 3 weeks. The few times I am forced into this situation, I fax it to them with an approximately 3-5 day drop dead date - I also inform them to send it via UPS or FE and to give me the tracking number because I won't believe them that the US mail is running late.

They have 10 days - 3 attempts to deliver - then it comes back...and yes it takes time but I like having the receipt showing they got it - or the letter stamped "Unclaimed" or "Refused" to show in court if necessary - without that anyone can say they mailed them a letter...this is your proof that an attempt was made to contact them.
I do agree with the faxing though - in addition to the mailings I also fax the letter - quicker and usually does get someone's attention - the one time I had to go that route I did fax the letter to the insurance dept - worked too!!

In PA, we don't have to show that we attempted to contact them ... we can sue with no notice.

In California, on the small claims forms all they ask is:
"You must ask the Defendant (in person, in writing, or by phone) to pay you before you sue. Have you done this? Yes or No"

There's a fellow notary here in VA that filed small claims suit against Flagship Title last August and faxed a copy of the filing to Flagship. Flagship immediately coughed up the money plus the court filing fees.

I've been successful faxing a copy of the paperwork I *INTEND* to file. Here in my county of FL it costs around $80 to file, so rather than filing then faxing, I do it backwards: I fill out the paperwork, then fax, with a cover letter stating my intention to file, if the payment of the debt is not recieved by xx/xx/XX08. I have only had to use this method twice, and it has been successful. Consider trying this if you'd like to avoid the filing fees.

that's what I do - fax the complaint with a letter - if it's a signing service, the letter is addressed to their client, the loan officer and everyone else I have contact info for (which is everyone) w/a copy to the signing service ... I ask for their assistance so that I am not forced to file the complaint. I give a very short time period, 3-5 days only. It gets the intended results with excuses galore from teh services to their clients ... we didn't fill out an on-application/contract, we didn't send a W-9, we didn't invoice, we faxed instead of e-mailed the invoice, etc. All excuses for non or usually late payment.(the not forwarding the invoice the "proper" way is my favorite. Dear Electric Company: I will not be paying my bill this month because you sent it via US mail. I request all bills be send via e-mail or I won't pay) Also, they seem peturbed with us when we contact their client ... who usually copies us on the e-mails asking why we haven't been paid ... because they know, they have paid the service for our services.
