Knowing when to say NO!

Disclaimer- just venting!!!!

Long story short...I was called yesterday at 5:10pm to get an Itemization of Financed resigned- due to the lender saying that they did not like the way the date looked. The person expected me to jump in my car and race to the borrowers and have this "corrected” Well, an itemization of amount financed does not need a notary present to have this document signed, in the first place. I told them my opinion....and the fact that I was booked solid for last night- today- and leaving town for the weekend. This was not well received. In my opinion too bad sooo sad. Why call me back at the last minute for something so trivial??

After my sheer disgust with the request....I remember this document was part of fax back requirement. So I pulled out of my documents (I scan and email back - fax backs). THERE WAS NOTHING WRONG WITH THE DOC!!!!! I REPEAT NOTHING WRONG WITH THE DATE OR SIGNATURE. This was a crazy request. I emailed a copy back to the contact and told her that there was nothing wrong with it. Please review...and let your client know that they must be confused.

Response was not good from contact- well if my client thinks that there is something wrong....then I think that something is wrong. Too bad you cant open your own eyes and look.

That is great- b/c the beauty of me running my own business is to make my own decisions. My decision- despite being busy would be to only go back out for a full trip fee. Well- I am pretty much kissing this account good bye- b/c she made it clear that they are MANY people that will help her out. I added in....I am sure for a fee.

I am not going to take this crap from people! There is no way that I am going to "fix" something that is not an error on my part. I guess that she thought that I am really desperate- and that I would JUMP for her request. Well, the signing was 90 miles round trip....and I only took it b/c I was in the area for another one.

I just can’t believe the nerve that people will have to "screw" the notary!!!!!! I am not putting up with any BS like that- bad market or good market. Don’t need the headaches!!! Thanks for listening- had to vent. Please share your other PITA situations Smile

Yup! Here's a new one. I took e-docs the other day

and I always print letter size xcept for huds. They got the pkg back and told me I missed the sig line on the DOT. .....I apologized, and told 'em I would fix it, 'Cause I want my money............but I said scan it and email it to me so I can see the doc. (Here's the place to pay attention) They called back about 15 minutes later and wanted to know if I could print it on legal? Huh?... Surenuff, you could pretty much tell where it had been whited out for my eyes only. After all, now really, how does one miss the sig line on the DOT??

So, they wanted the DOT on legal and concocted this plan. Xtra trips hurt!

This is just a gripe

I noticed I was paid half my fee, so I called to find out why. They told me that the borrowers said that I complined that I had to work on my day off. I know better than to do that, so I double checked my notary book and I signed these people on a Tuesday, and I had 6 signings that day. I called my people and told them it was not my day off, and I had 6 other signings that day. But they would not budge.

Another time, a borrower took 2 hours to ready and call in about every doc. He kept asking me a lot of questions about "what do you think?" I kept telling him I am not allowed to give advice or opiniopns, and he kept calling his processor. I am VERY aware of the pentalies for "practicing law without a licence", so I NEVER give advice or opinoins. Besides, I have no idea what his financial situation is, and if a loan is good or not for him. Anyway, he signed everything, and I was just glad it was over.

Later he told his people that I advised him not to sign the loan. Of course, now I was in HUGE trouble: his word against mine. I defended myself to the SS and as well as saying, "If I told him not to sign the loan, then why did he sign it?"

It turned out that he wanted out of the loan, and they had to re-draw, and they wanted me to go back and do the signing for free. They didn't SAY that, but they told me if I go back on the re-draw for free, he will drop the accusation. What an evil person to play with someone's life like that, so they can save a little money.

Consider using the "Notice of Refusal" form

on PAW's website to avoid "he said /she said" stories. It comes in handy to send back with your closing report instead of the usual tracking numbers. You may even complete it for them - so long as they sign it.

I was called by a title company (who shall remain nameless) and told I had missed a signature on the mortgage. I told them I check and recheck all of my work and I couldn't believe I missed that, but that mistakes do happen so I would be willing to correct my mistake for no charge if they would send me a copy, via fax or email, of the mistake. I was put on hold and when the gal came back on the line I was told "sorry it isnt the mortgage with the missing signature line, there was a quit claim deed that should have been added to the packet that was not sent."

I told her I was relieved and thought for a moment I had lost my mind. We both had a laugh over that. It was good to know it wasnt a mistake on my part. I immediately asked her to send me whatever paperwork they still needed and lets get the job finished. (after all, this job is a team effort and letting the rest of the team down is not an option, IMHO)

I remained calm and professional as I quoted them my fee to have this document taken out and executed for them. I didn't jack up my price or get nasty with them and we got the job done. Yes, it cost them more, but they now understand that I am a professional and they call me time and time again for their closings and each time they call we treat each other with the respect a professional deserves.

Anyone ( ok, almost anyone) can handle a smooth closing, but only a true professional can handle the difficult ones and keep their clients coming back. Is that not how strong business relationships are tested and formed?

Letter size only?

I think you're the only person I've ever known to do this, tinkie. Most TC's will accept legal size only, or a mixed package... but letter size only? Sounds like a good way to clip off pertinent information on certain docs that require sigs or initials on each page, like the 1003.

it prints right, its gonna be letter size....... Time, Ink, Paper......... O/N's no problem. Never a problem til now. New client.

tinkie...I can honestly say that if I printed on letter sz

a good bit of the time the print would either be too small to record in some recorders' offices or many documents would have the bottom cut off. I am surprised that you do not have trouble getting your work accepted on all letter size paper except the Hud. If I had to make a rule of thumb for notaries who are new at this, I'd say print on legal -- not letter -- if you have to make that choice.

The SS/Hud isn't as critical to print on legal as the DoT is...it's not going for recording.

One title company I work with in my day job sends me scans of the closings for our client's file. Many times the hud is reduced to letter size...and sometimes I even print it on letter for our client to sign if it is unhandy at the moment to use legal. But a recordable is a different thing...it can't be printed too small to be read easily or too small to be digitally archived/scanned at the county clerk's office.

But, I'm sure you know what you're doing...I'm just surprised, that's all.

Who else is printing all on letter size?

I have never heard of such a thing as printing all on letter size...but I have heard from numerous clients that it is acceptable to print all on legal, if no mixed.
In most cases, within the instructions it will say NOT to print all on letter.

I am not so sure tinkie is working as an NSA.
NOT printng all on letter is pretty much covered in "NSA 101".

Let me guess...

it was a Countrywide, right?
Having closed several hundred CW's, I can attest to their date-clarity-fixation on funding docs. I make it VERY clear to the Borrower on a CW loan that a messy date WILL affect funding. There's no rhyme or reason to it... it's just the nature of the Countrywide beast. No European numeral 1's allowed... no crossed 7's... no fancy 9's. I show them the Notice Regarding Notice of Right to Cancel and it gives examples of how they want their numerals written.
Yes, it is a P.I.T.A., but in the end, it's the lenders call.

*this is not to say that I think you're wrong, btw... you have every right to decline a request you deem to be ridiculous Smile

Yes- CW. This TC has a CW department- which- I had a run in with this same person before. They forgot 4 docs out of an email package to me....and called me up saying that I did not get them signed. I called them on it....and then they tried to get me to go out for free for their mistake. This women knows that she can not push me around....and she is PO'ed that I wont take her crap.

Everything happens for a reason: after this 2 TC's called me back to back- local- I might add- wanting to set up meetings to discuss using my services. So- you have to go through hell to get to heaven!!!!!! and I am not even religious!!!LOL.
