NC Notaries - Information and help requested

I understand that NC is NOT an attorney only state but that there may be legislation out there to make it such. I need somehow to confirm that notaries can do closings in the state.

I have spoken to customer service at the Secretary of State's office but they refer to the Notary guidebook-10th edition section 5.2 to see what a notary's duties are in a real estate transaction and dont really answer my question, just give the runaround.

Does anyone have a copy of this that they could fax(888-229-4250) to me or any other documents that would back up that a notary can legally do real estate transactions. Thanks.

NC has changed over the years, lawyers from NC have tried to make it a AO state. The NNA was pushing for a time too. IIRC the law changed sometime last year in favor of the lawyers.

I know in NC you cannot charge a travel fee, so you need to make up some reason for the additional fee's other then what you can charge per signing.

I have friends in Cary, NC told them how to do this years ago, they got there comission, bought the laser printer, and other things but never followed through with marketing. They could of made some good money in that area a few years ago.

I am a full time certified signing agent in NC and have been for over 4 years. It is NOT an attorney state and the lawyers tried to get a bill passed in the last legislature and it was turned down. I emailed every state senator and told them tis bill would do nothing but hurt the consumer and the lawyers would be like a monopoly and charge whatever tehy felt.

It is true as a notary to do notorial work here in NC you can only charge $5 per siganture you stamp. NOTHING ELSE. I used to do alot of mobile notary work and now I turn most down because I cant go anywhere for 5 dollars. I refer these people to a UPS store , they have a notary on staff.

The attempt to stop a non-attorney from doing loan signings was overturned late last year. Many loan signing agents wrote all of the state senators to help with that effort and were rewarded for our efforts - hopefully for a long long time.

The loan transaction must be overseen by an attorney, this is generally accomplished by an atty on staff at the title company or other.

I am a certified loan signing agent and a notary. I perform the loan signing function as a certified loan signing agent and then I also notarize any required documents.

There is not much in the way of documentation, if anything at all. The notary handbook only deals with notarial responsibilities.
