Notarizing the Note

Hi fellow notaries, I am doing a closing today and they want me to notarize 3 notes, I have never notarized a note before here in Montana, this seems odd to me, any feedback would be appreciated.

It's not done very much, but sometimes I am also requested that.

Haven't had one since..Just make sure they let you know if they want an ack or jurat..you're notarizing the signature, not the doc - Like Misty said no big deal.

I called the company and they told me that the investors want 2 of the notes to say certifed true copies, I planned on attaching an ack. That should work right?

I think Linda means does your state allow you to certify copies in a notarial capacity.

no, that won't work. Call your client and have them explain to you what they want. "Certified and true" has nothing to do with notarial acts in this case.

If they do not already have this stamped on the note itself, you should have the borrowers write it on the page where they sign. Then you just notarize their signatures as someone else stated.

Signing multiple notes without indicating that all but one are copies is a very bad idea for the borrower, no matter what state they are in.

I guess I should have included a 'smiley face" or something. I said "good" advise, meaning I agree (for what that's worth) and free. Something one seldom sees. I applaud the attorney contributor!!!!! Good on you!!

you can't decide if it is to be an ack or jurat.....the.....

document maker has to make that decision........are you allowed to certify copies in montana?......there is a difference in certifying a copy and notarizing a signature.....

Answer to my question.!!

Okay here's the answer from the State of Montana itself. When I notarize the original I put my wording on it then sign it, then make 2 copies of that and certify that the 2 copies are true and correct photocopies of said document signed by the borrower on said date.

NO ABSOLUTELY NOT

You cannot notarize a note...


.... you could notarize a signature on the note though

In CA I couldn't certify a copy, but I could acknowledge a dozen wet signatures on a dozen copies of the note.

You could also do a notary and leave a note when you're done... call me if you need any help with that one.
