Question for Missouri Notary
I have a double loan siging (refi's) on 2 investment properties in Missouri, that I will be completing here in Florida on Sunday. Both loans have a Deed of Trust. What is the WITNESS requirement for a DOT in the state of Missouri? Do I need 2 witnesses, and can the notary be one of them?

There are Normally NO Requirements...
...for witnesses on a DOT in the State of Missouri. Having said that I wouldn't take my word as gospel in this situation nor should this be considered legal advice. I'd call the Title Company for specific directions in that regard if you have any doubts.

I have had MO property signings here in WI (usually members of the military) I followed WI guidelines which do not require witness's. No problems afterward. I believe most, if not all states recognize and accept notarial acts performed in other states.

Notary laws, though, have nothing to do with the witness requirements. While other states will recognize and accept notarial acts performed in other states, the real estate recording laws are different.
I suspect that if a signing is done in another state for recording in a witness state, that when the docs get back to title, someone will sign as witness even though they didn't actually witness the signing. Sometimes they will send the deed back to get it re-signed with witnesses.

Oh Sylvia, You remind me of a long time ago when the grass was green, and I was greener. Now NH is not a witness state, but I wasn't aware of all these fine points (REALLY green) About the third company I got an assignment for called me up and had me put in a couple of names in the witness section of a mortgage and I did it. Those nice people wouldn't steer me wrong, right? Thank God I finally found NASA (the old one)
