Ca Notaries, new acks
There was a discussion a little bit ago on exactly when to start using new acks. Well I just found out for sure. I had a signing on the 31st, second guessing myself, I used the new one. I got a call today from title, the recorder would NOT accept it! Title was very nice about it, they had thought that would be OK too. Sooo glad that's the only one I did that with...

The new laws went into effect 1/1/08. Why would you use
The new certificates before that?

I don't get it either
But I think we're in the minority on this board. To me it seems very cut and dry, it's not a recorder's office issue it's a notary law issue. Anything notarized in 2007 should have the old wording, anything notarized in 2008 should have the new wording, the wishes of any particular client shouldn't override the law.

There was a discussion about this earlier in the month. Many from the So Cal Area said that the county recorder would reject deeds being recorded in the first part of January that were notarized after the 27th of Dec. with the old wording. I think is was Riverside County. So much confusion, I called the SOS myself and they told me to diffently use 07 wording throught the EOM. I am in Nor Cal and called my counties recorder and they said they would not reject anything notarized in 07 to be recorded in the first part of 08. New laws took effect 1-1-08 therefore we should have not used any new wording in 07. Glad things work our for you.

Well, I gotta agree,
it was stupid. Everytime I second guess, I regret it... Just for clarity though, I did not ask the client which they wanted, they were just surprised it didn't go thru.

Well, I'm glad you spoke up. I saw the new wording pre-printed on a document before year end and hadn't really thought it through yet. (I was not feeling well and not having a good day...) You convinced me, though, and I continued to use the old wording until the end of the month. No problems, fortunately, perhaps thanks to you!

Here in my office, one department has a document that was returned by an Escrow Company, it was notarized by one of our in house notaries, in December, using a 2007 compliant acknowledgment. Escrow returned it requesting the new wording acknowledgment.
I advised them that it matters when it was notarized not when it is to be recorded. The escrow company is incorrect. The notary who performed the work is out today, but I intended to advise her of the issue when she gets in tomorrow.
