If you're referring to the co. in NJ they are great to work with. Pay off the HUD. Search for Convenient Closing Svcs. or Title Resource Group.

Thank you Dawn, I've already completed the assignment. The only issue I had the documents were dated 01/31/2008. It must be mistake. I notarized Jan 30, and did not touch their dates because some companies don't like any corrections. I tried to contact Donna but she was away from the office.

I've always had the opinion that dates on a document are for the lender to handle. Unless the instuctions specifically state the documents must be signed on the date of the documents, and that date does not match the date of the signing, I'm not calling.
If they feel there is a going to be or is a problem with incorrect dates then they have a typewriter,they can fix the dates if they want to. Notarizions reflect the actual date of signing, document dates are their problem if there is one.

I recall somewhere in the handbook that you aren't suppose to notarize doc's with a "post date" on them. I don't know that I would have accepted and dated 1/30 when the docs were for the following day. I'm funny with that. I would have waited and asked for them to correct the dates or if I could have corrected it. I'll find where is states that.

In FL, the date of the doc must precede or be signed on the
date of the document. Those docs wouldn't have been able to be signed until the 31st here. You might want to check with the laws in your states for being a notary before sending those docs out.

In Maryland there is no prohibition on date documents. I'm curious about Florida. You say the docs cannot be signed before the date on the docs. What if the lender said "ooops, we made a mistake, we will cahnge the date when we get the docs back". Would that be a problem?

I wouldn't risk losing my commission on the word of any SS or TC. The date would have to be changed before they were signed, the borrower could do it and initial the change at the table as we sign or they would have to send a new package with the change already made, no exceptions in my book.
I don't understand how can you notarized something that isn't in effect on the day it's signed and it be valid in court. Regardless, our rules say it's not allowed.

Not my call to make if they would be valid in court or not. If the lender wants them signed, we sign. My notarizations would reflect the date of the signing. My notarizations would comply with state law. Whether the documents would be valid is up to a judge.

I'm sorry if what I said wasn't clear, our state law doesn't allow us to notarize docs that are postdated. Therefore, I don't care if the company wants it signed with a postdate, I'm not doing it for any reason. It's also illegal to alter a document after it's notarized, so the assurance from a TC or SS that the date on the docs will be changed to coincide with the notarized date is an illegal request.

I got what you were saying. I was just stating that my notarizations would comply with my state law. The docs were the lenders problem so to speak.
Question though. You state that to alter a notarized doc would be illegal in FL. So no typographical errors could be legally fixed? How would you know if a lender or TC corrected a typographical error after you send it back? If for some reason you were called into court to verify your notarization would you be able to tell if that was the same doc you notarized in its entirety without any changes?

I guess that's why on occasion I get paid to go back to the borrower and get things re-signed that were notarized.

You must work for some honest lenders, who must know they would be in the wrong in FL. Most of the ones I've dealt with wouldn't give it a second thought to correct a document. Especially if that meant money to send a notary out again.LOL

I made a mistake in posting this, I used the wrong manual that was issued by xyz corp. instead of the Governor's manual. You can notarize predated docs, but the recorder may not accept them. However, per SS117.107 (7) & (8), the document can not be altered or changed after it is signed or notarized. I am sorry for posting the wrong information.

The last time that happened to me....
I found that the scheduler made a mistake for the signing date, and I had to have everything re-signed the day of the date on the docs. You should be diligent and be sure to check before they are sent back.

I did a closing for them on 1/26/08. A total no brainer. "Sign here" & "notarize here" stickers through out the entire package. I was paid on 1/31/08. They sent the check via UPS. I'd say great company to work for.
