Reject Ack. - What would you do?

Last week I received an email from a title company saying that the county rejected the acknowledgement i did back on 11/12/07. I used these CA acks all the time and never had a problem with them. The wording is in fact 1" away from all sides however there is a border that is probably about a 1/2" from the margin. I asked them to send me the rejection paper of which they did....this is in Clark County, CA and reside in Riverside County...the property was in fact located in Clark.

The rejection is dated 11/30/07...many days after i notarized it. Also, the rejection doesn't state any info on it re the borrower name, etc. How am i to know that this rejection is for the one i notarized?

Why would it take the title company so long to notify me?

What should I do?

Did they tell you why it was rejected?

And did they say what they wanted you to do about it?

IMO, I'd reply and ask them to send me a copy of the document in question. That's the only way you'll know if it was YOUR document or not. Like you said, how do you know it was your notarization that was rejected? In the meantime, check the property records for Clark County and see if that document for that particular signing was recorded - if so, then someone's trying to put one over on you. If not, and that document hasn't been recorded yet, it won't record now with the new laws in effect in CA, and it will need to be re-signed...and that's what may be happening - a whoopsie - someone missed the recording or forgot to notify you in time and they now want a freebie.

Yes, they did tell me why it was rejected....b/c the wording in the ack are not 1" margins on all sides...of which, it is. They sent me the ack i notarized and then they sent me a rejection sheet from the county they said belonged to the ack. There is nothing to verify that the rejection belongs to my particular ack...just a rejection stating wrong margins.

I may have to call the borrowers to find out what the property address is b/c i don't have it. The docs were overnighted and i don't have edocs to refer to. Does anyone think this would be a bad idea? Then i could call the county to confirm.

FWIW, I just did one last week that was also to be recorded in Clark County. I was going to need to certify a copy of a POA and they sent me the verbiage that they wanted used. In response, I fortunately sent them a copy of my cert for that purpose to see if it would be acceptable for their needs. They responded that the border was within the 1" margin and wouldn't be accepted by Clark County. Who'd a thunk!!? Since I do my own certificates in Word, I was able to fix it by deleting the border -- and was mightly glad to know in advance. Point being that they are probably NOT making it up.

For the record...

I missed the "CA" in the original post and assumed that it was Clark County, NV that was being discussed - probably because that was where my docs were going. I'm sure that was what AJ meant. (Haven't we all typed or written in our own state by accident out of force of habit -- at least once??)

Address should be on your paid invoice..

or the copy of the confirmation you had for this signing. IMO I'd leave the borrowers out of it for right now.

Sorry, i should have referenced which state the county is located in...Clark County, WA. There was no ack to notarize so i had to attach one and used the CA ack. However, i never considered the border to count as part of the 1" margin, just the wording.

I live in Clark county, WA

and those folks can sometimes be sticklers and then sometimes their not. It can be hit or miss, but I do make sure that I keep the inch border.

Thanks Philip, I've never had anything rejected before...i'm just trying to be careful as i don't want to give in to title's request for a mistake they may have made...still can't figure out why it would take this long to inform me of this.
