Rene You do realize that GA is an attorney only state and notaries cannot do loan closings in the state of GA.

"If" GA is like DE than notaries can do 2nd mortgages and equity but not purchase and 1st refi. Would need checking into.

No..not like DE
My understanding of it is notaries in GA cannot do loan signings for ANY transaction that would, among other things, create a security interest in a GA property (i.e. mortgage) - I don't believe they can tend to purchase/sale packages either since, in addition the security interest, the property is conveyed at that time. Again, that's my understanding of the legislation....GA attorneys correct me if I"m wrong, please.

A couple of years ago I did a signing here in CA for a GA property. I did need a witness, but I'm definitely not a lawyer. I'm wondering how that works, is that kosher? I know when I do TX Helocs we always have to be at a title office, (although a few times when it was a late signing, we were just in the buildings reception area!) It is interesting how different states work things...

Christi There was a discussion on this a couple of weeks ago. GA Supreme Court ruled that notaries cannot close loans WITHIN THE STATE OF GA They have no jurisdiction outside the state. I have done several loans for GA property.

Got on this subject with a title company the other day and they said when they have a GA property, theyve had a GA attorney on the telephone during the transaction. Not sure if this covers it but that's what this particular company said they do.
