I did a signing back in October for a girl that is a notary. She was in a bind , she sent me the confirmation that the signing service sent her, borroweer had docs and her sister was sick and she had to do something, and could I please help her out? I did it, hour drive one way. So now is the problem of trying to collect my $$. I've sent emails, sent her an invoice, called -no answer. She has a nice website to promote her business, I didn't think she was a scumbag. I called the signing company and they told me she was paid December 3. Things are really bad when you screw your fellow notary.

That's terrible. Notaries are supposed to have integrity.

We need to have the integrity it takes to go into court and say, "Yes, this person signed on this date." Now we even have to do it "under penalty of perjury", as if fines and jail time wasn't enough incentive. There is a notary in another state with my exact name, and we frequently get each other's checks. I could easily keep her checks, but I would feel guilty. "A clear consceince is the best pillow". I don't understand either how notaries can take advantage like that.

I think what anyone should do when they are contacted by another signing agent to
take over a signing, they should call the hiring entity to make sure it is OK to take the
other signing agents place, and ask the signing company to send a confirmation and
agree to payment. That way the signing service would be paying directly.

I know if I make a mistake, they can sure find me fast to fix it. They need to know who is doing their signing.

Yes, I have a suggestion. Obtain and complete the necessary forms to file a small claims suit against the other notary. Put a date on there sometime about a week in the future. Fax those forms along with a demand letter for payment, saying that if payment is not received withing X days (pick a short amount of time) then you will be filing these papers on the date indicated on the forms. Then if the other notary does not pay you, follow through with the paperwork.

I had another notary do a closing for me. I met him and gave him the docs and paid him cash on the spot.

Shame shame on her. Bet she doesn't sleep well and what goes around comes around.

I agree with Sylvia. The companies confirmation and payment obligation is to the first notary only. Without permission or contact with the hiring entity, the second notary has no recourse if the first is not paid or even if the hiring entity decides the first acted without permission. You can be fresh out of luck either way. Shafted by the notary or no obligation by the co..

My suggestion on getting paid...

Call the hiring party - get a copy of the canceled check showing she cashed it - they should have a reference on there as to the borrower's name...then get a copy of the recorded security instrument showing your notarization....submit all that with a copy of the confirmation forwarded to you by the other notary together with the demand letter and a copy of a draft of a small claims complaint that will be filed, as someone suggested.

All my opinion, not a lawyer, yada, yada, yada...the one thing I will say is you need to be willing to follow through with the small claims action so she doesn't start to think you're just blowing smoke.

Simple, drive over and knock on her door and demand payment on the spot. And if that doesn't work pay a neighbor kid 10 bucks to throw a rock through her window 3 days after you've left Smile.

Not about driving over and knocking on the door. Obviously they must be in the same geographic area.

As for the other part, it's a joke. What I really meant was that the neighbor kid should slash all 4 of her tires in the middle of the night.

I feel so dumb, that I am so trusting of other people especially another notary. I keep thinking maybe something happened to her,since I haven't gotten any response.(still Trusting) I think if she sees the caller id, that doesn't help either. Maybe I should have someone call her from another area code just to see if theres an answer?

Linda you could call by dialing *67 before dialing their number. It comes up as your number being restricted. That way they would not know who is calling. It's worth a shot.
