Just want to say thanks for all the posts! they have been very helpful, even for us not so new notaries. At least I find them helpful since moving to another state that is different than what I was used to.

They are bringing it to your attention that GA is an atty only state for loan signings.
NP's cannot facilitate the signing the way it is done in non-atty-states.
In GA. only an atty can facilitate a closing.
If you are doing these in GA, they are being done illegally.

Mistarella's post is correct - that's all we were trying to do...glad to hear you're not doing it illegally....so you know that having an attorney on the telephone is not sufficient under GA law...the attorney must be present.

Why assume that just becasue she is a notary and resides in Ga and posts on this site that she is illegally operating as an non-attoryny NSA. I am totally baffled.

Well, it took alot of guts to admit to doing closings in an attorney only state. Borrowers may have a mess to clean up and it is not fair to them.

Interesting profile. The first two sentences read, "I am a Florida and Georgia Notary Public. I am not an attorney." This presents TWO problems:

(1) To be a Florida Notary Public, the person MUST be a Florida resident (FSA 117.01 - Appointment, application ... and FSA 222.17 - Manifesting and evidencing domicile in Florida). Residing in GA would be a disqualification.

(2) To do loan signings in GA requires the facilitator to be an attorney. (UPL Advisory Opinion 2003-2 (277 Ga. 472))

Another interesting aspect to her profile is that she does not provide her name or contact information. Given the above to issues, I can see why.

That was probably a big mistake linking her ID. Her name is definately out there now. Any curious lawyer could now research DOT's looking for her name. She's probably going to have some questions to answer at some point in time. I would think it would be much easier to catch someone in an attorney only state. Look at MA, they did it.
