Anyone have any comments if this operation is still in bursiness...I think down in Florida? They want you to know what the dower or marital state laws are in your state (I'm in Vriginia...and it DOES vary by lender and title company...wherther the non-borrowing spouse signs the HUD, TIL, TRC's, Itemization of amounts financed. And if you get it wrong...oo-oo-oo - and YOU WILL GO OUT TO FIX IT.... tomorrow!!!...at NO ADDITIONAL COST!!!...because you should known better......(As an attorney would know??)....

SHEEZ....anyone have any experience with this sham "company"?!!!

there are many 'siging agents' on these boards that also feel you should know this and make the call at the table. I truly feel you are absolutely practicing law if you get someone to sign legal documents whose name is not printed on that document unless your client has given you specific instructions to have a spouse sign certain docs. Blanket instructions from a signing service certainly wouldn't cut it with me and I certainly wouldn't go back out for no fee. I may KNOW what's right but that doesn't mean the lender agrees and it certainly doesn't mean that I make the decision. Many companies 'get it wrong' in PA but they're the ones lending the money and doing the insuring so it's their call.

Had one just the other week - they are getting divorced - he signed a deed to her at the original closing to remove his name from the property. She refinanced in her sole name - as that was now how the property was being vested. A few days later I returned and they had him sign the mortgage becasue they were still technically married. What a schmuck.

I did a resign for GAC a few years ago - forget the actual situation but basically the wife wasn't on the deed and there was some type divorce situation but they wanted her to sign the mortgage anyway. The initial notary refused to do it saying it wasn't right. I agreed; however, I took the $150 as it was none of my business if she was that much of a dimwit.

Couple was separated 10 or 15 years (but not divorced) and Mrs. owned a house with her boyfriend. HFC manager tried to convince the husband he had to sign the mortgage and that would extinguish all his rights to her property (he didn't even now she owned a house). Husband was having no parts of this. The manager looked at me and said something along the lines of "Won't putting this in the court house remove all his rights?" I was on my last leg with this branch anyway so I said, "Sounds to me like he's got to go ask a lawyer". What a schmuck (manager, not husband)

Several times a year I get a divorced/divorcing couple and the LO tells the spouse who isn't keeping the house that they're 'signing off' the Mortgage. I tell them they're signing on - there is no signing off. Signing away their ownership to the house but signing on for 30 years on someone else's Mortgage - schumcks.

I've seen that countless times over the years. By the way Diane, when you quote this post, please don't call me a 'signing agent' like you did last time - I don't use that term for myself as I truly dislike it. Remember, personal responsibility - these people are getting divorced and have lawyers - because they choose not to ask their counsel in this part of the divorce is not my fault. When I worked in a law office, there were 2 attorneys who did the family law - when there was real estate involved, they insisted our office handle the closing so they were certain WARRANTY not Quit claim deeds were used, that vesting was proper, that the final paperwork jived with what the marital settlement agreement was going to state, etc.

I think all signing agents should BE AWARE that their state laws have an impact on who signs what and where...then mention it to title and let them make the call...I always let title know we're a homestead state here, sometimes avoiding last minute problems (and no - title doesn't always already know).. do I make the call at the table? No...absolutely not. JMHO
