I recommend starting the collection process and add on the charges for the nsf fees, collection fees and interest, worked for me....

I would recommend calling them and telling them that it bounced and that you want a cashiers check in the amount of $250.00 (or whatever the amount was) PLUS the fee it cost you when it bounced OR you will head straight to the DA's office and let them handle it. JMHO

Sorry about the check. Can you redeposit it? Maybe the bank will let you put it in for collection.
Finish Line...that sounds familliar. Where are they? Is there just one?

Do not redeposit the check. If they stop payment on it, it is no longer a bounced check and the police will not move on it.
Comply with your state's requirements with respect to referring the matter to the police. In many states including Connecticut you would be required to notify your client of the bounced check and demand payment by certified check (including your bank charges) within the number of days required by law (10 days in Connecticut). Works every time.

Check your state law
Do not redeposit the check. Notify them that the check bounced, and demand - by certified mail - a certified check the full amount plus bank fees within however many days your state allows (in NY, it's 10 days). If you don't receive it by then, you should start legal proceedings.
Requirements for bad checks vary by state, so check your local laws. Here, we have to be able to prove that it was done intentionally, which may or may not be easy to do.

In New York State the law says that you can collect triple damages for a bounced check. If that check had come to me, I could collect $825. I was in court once where a woman who had written a $300 check that bounced was instructed by the judge to write another check for $900. Check your state laws carefully. A bounced check may be a blessing in disguise.

Thank you for the responses. The woman on the phone was a bit "flighty" with me, "let me guess, your check bounced. Yeah, we forgot to move money, happened to about 65 other notaries. Just go back to the bank and redeposit it. If the bank doesn't honor it this time....blah blah blah blah....can't redistribute the funds (or something like that)."
I'm going to take your advice and follow state law. Thank you for telling me NOT to redeposit it!
