Crazy II

I got a conference call from a lawyer and a title person yesterday about a closing I had done on 3/20. The lawyer was furious because I had Xed out the FKA on the quit claim deed. He was yelling and being really rude. I have to admit some of these closings just run into others, and I couldn't remember having deleted anything on the deed. He wanted me to drive back to the borrowers (1 hour each way), do a new quit claim deed, the tax docs they hadn't originally asked me to do, and then drive to another town to record the QC, tax docs and mortgage and he was going to pay me $25, because it was my fault (according to him) that this thing had happened and the recording was delayed.

I asked him to fax me the QC. He wasn't kidding. The FKA had been XXX and initialed. I have never XXX anything in the 5 years I've been doing this and I'm certain neither borrower did that and I called him and told him so.

As soon as I hung up with him, the title person called me and told me they had done it, but they didn't want to pay me to go to the borrowers' and found someone else.

Absolutely amazing.

Unless you get alot of work from the Title company I would let the attorney know that it was not me who messed. Buisness is already bad enough you don't need to have an attorney speading around that you don't know what your doing. The phrase Small World come to mind

ronda...where was it crossed out.....at the beginning.. or..

where they signed it or in the notary block.....if it was the notary block, remember that only the notary can insert what goes in there...no title co..no atty or any one else...that is a notarys testament under oath that what is in that block is the truth.......

I haven't heard of them doing what you mentioned above, but I've been told they sign things they should not be signing.

You're right, absolutely amazing however when it comes to our notary responsibilites and the repercussions that may follow us, sometimes years down the road... and perhaps at the cost of our entire business and/or commission... for someone else's wrongdoing!

Anyone who has notarized numerous docs to be recorded (in our case, mostly mortgages) would be very surprised if they went to their local recorders office and looked them up. There will be quite a few that are not in the same form as when you turned the doc in.

I have been told that companies will insert the info into the certificates to be in compliance with the lender if refused by the notary.
Example would be: Jon Doe and Jane Doe(what the notary puts) as Husband and Wife(what the company puts)
So I completely agree with Sue.
