Please respond to my question ASAP--ID being renewed
He has proof that his passport is being renewed, can a notary notarize an affidavit without any valid ID, I think the answer is no right? He has working permit with the picture on it.

Does the renewal have an experiation date on it....would he be able to travel with it? A drivers license renewal has an experiation date on it in Michigan for like 30-60 days until you get the new one in the mail....dont really know if there is no experiation date on the passport renewal.
If he has just applied for a new passport and does not have an extension on it....then that sounds shady to me and it is experied and not valid.

Does NY allow the use of credible witnesses? If he doesn't have ID or the ID presented has expired, I just record the expired ID in my journal along with the credible witness' information and signature.

I wouldnt do it in CA. When you get your working permit it takes years to get the passport, why in the world is he renewing his passport and still has his working permit?

Lets review
I'm guessing this is the situation: The client is not a US citizen He has a foreign passport, which he has sent away to get a renewed passport He has a work permit, issued by the US government, with a picture on it
If that's the case, why do you feel the work permit is not vaid ID? New York does not seem to have a notary manual on the web, nor any advise on the web about what forms of ID are acceptable.

I think a work permit issued by the US government would be sufficient ID in Vermont; send him over here.

If New York does not have a web based handbook that you can see the state ID requirements, I would call the SOS (Secretary of State) and ask them what is allowed as a valid form of ID in your state. Dont take any chances and you wont pay the price for being wrong!

NY does not have a list of acceptable types of ID (yet). It's not cut and dried - you are required to have "satisfactory evidence" that the person is who he says he is. If what he's presenting is enough to satisfy you of his identity, then go ahead; id something strikes you as not right, then decline.
