Check bounced....bank resubmitted check in 2nd attempt to clear it. If it doesn't clear, that's another NSF fee. I accepted another signing from them *before* the notice from bank came so now I'm out almost $300. Won't accept anything else from them until they pay all that they owe me.

At least CoverSign's check cleared.

That too, and since they are not close but still in drivable distance, I will be taking them to small claims court.

From the info on filing a small claims, the case would be tried in the county where the business is located. What if the SS were in another state? How does one sue another who is in another state?

if it is a small claims matter you get a complaint form from the district in which the case is to be filed, fill it out and send it in. It may require you to appear in court to testify. If they default it is possible that you may not have to appear in court.

NSF check discussion aside:

In Texas...

§ 28.011. VENUE. An action in small claims court must be
brought in the county and precinct in which the defendant resides,
except that:
(1) an action on an obligation that the defendant has
contracted to perform in a certain county may be brought in that
county; and
(2) an action for which venue is proper under Section
15.099, Civil Practice and Remedies Code, may be brought as
provided by that section.

Filing in Small Claims

I went to paralegal school a LONG time ago, and I think you could also file where the "crime" was commited, like where YOU live, and make THEM drive. Also YOU conduct your business near your house, so that counts too. If that is the case, maybe they won't show up, and you could win by default. But they might be able to file to move it to their place, that would be a problem for you. Anyway, if you are serious, don't give up without looking into it.

You do not have to bother with small claims court. Simply contact your local District Attorney and they will be more than happy to collect on that check for you. They could be liable for up to 3 times the amount of the check.

Thanks, I will do that. Since it's unlikely I'll get paid for the 2nd signing, I'll just go after them for one lump sum of all monies due.

Actually it is best not to redeposit a bounced check. If they stop payment on it the police are not likely to move on it, and you may get charged with another fee.

The best method of dealing with it is to comply with your state's notice requirements for rubber checks. In Connecticut we send written notification by certified mail informing them that the check was drawn on insufficient funds. In the letter we give them ten days to send a certified check in the amount of the bounced check and bank charges or the matter will be referred to the police. Works every time.

I will definitely pursue this matter and will report S.C. to various state and consumer agencies so it will be on record that they are deadbeats.
