Some of you may recall a post of mine (#216536) regarding a signing in which the borrower’s first and middle name had been reversed on the Deed (as well as the previous Deed). I spoke with the LO at the table, explaining I could only notarize using the name on the ID, and he decided to utilize the AKA statement to reconcile the issue, as opposed to signing with and “aka” on every signature line. Afterwards, the LO (a broker) called to say the Lender wouldn’t accept this and I needed to notarize with the names reversed or they’d have to redraw. I of course re-explained and ultimately was told by both the LO and the TC that the Lender allowed it to go through as-is. This was back in October 2007. Now, five months later, I get an email from the TC saying they need a new acknowledgement with the reversed names so they can record the Deed, “as that is how he’s vested on the purchase docs”! What!? (An aside for those with TC experience: how does a Deed not get recorded for five months? Legal ramifications? Just curious.)

I would - I'd be real curious to see if that first deed was, in fact, recorded...

No, and it's in another county. If I get over there any time soon for another signing, I'll try to do that. I wonder if Andy's right, that this is resulting from an audit, and now they're scrambling.

Re: the risk for the title company
If the deed has not been recorded, the risk is that many things can attach under the seller's name since they're still in title...i.e. judgments, divorces, deaths and probates...could be a big problem for the title company
