Alabama Notaries

Has this happened to you? Twice this month I was asked if I used, in addition to my embossed notary stamp, an ink stamp. I replied that I did and they were relived. They (one was a Broker, the other a Title company) both said they knew it wasn’t a state requirement but for their transactions (a loan closing, and a POA) it was necessary. I didn’t spend time trying to figure out why it mattered to them, because to be honest, I don’t care. But I am curious to know if this was just a fluke or if any of you have encountered this recently in the State of Alabama. TIA.

I know I'm not in AL but I'm thinking that the reason they want an ink stamp is that it will photocopy with no problems whereas the embosser, even if rubbed over, could not copy as well. Just a guess.

Hi Michelle,

I am in Tennessee but that is the exact reason that the state of Tennessee no longer allows the Embosser. In July 2004, the state changed to the Ink Stamp and only allowed the NP commissioned before the new law to use their Embosser until their commission expired.

I am glad that you do use both.

Thanks, Tannis.

That explains some other calls I've received in the past. Perhaps Alabama is moving in that direction. I'll call SOS and find out.

Michelle, I only had that one time a couple of years ago that a company called and said I forgot to stamp everything. At first I was puzzed - how could I forget to stamp everything. Not that I haven't ever made a mistake but the whole package??? Then I realized they were looking for an actual stamp which is not required in AL. I explained this to her and never heard anything else but I did order a stamp and have used it everytime since then!

Deb, it's good to know I'm not alone in this.

I started thinking that I was the only one double stamping forms. I know my general public customers appreciate it as they are often faxing or copying the notarized documents. Now it seems lenders like it as well.
