Hello Agents,
I have a question: I did a signing for another Notary and it was completed 6 weeks ago, now that I want to get paid he doesn't answer my calls or emails. Besides small claims is there another avenue.

Gloria, Send him a letter certified, asking for payment by a certain date and also contact with him on the matter. Specify in the letter that if he doesnt make contact and payment by yada yada, you will be filing a report with your SOS (or is it Attorney General, cant remember, havent had to do it yet). And if in your case you are capable, you will take him to small claims. The certified letter usually gets their attention and you wont have to proceed any further, but keep in mind if he doesnt respond be prepared to carry thru with the rest of the conditions of the letter.

Suggestion - if you send him a certified mail, be sure you send it with a return receipt card. Also send him the same letter by regular US mail. Now, if you get the certified letter back due to no one wanting to sign for it, DON'T open it. Just put it in your file and when you file suit (and if the debtor says he "didn't know he owed you any money nor did you ever try to contact him by mail or otherwise" you will have the original to show the court and as long as its not opened, that will be proof that an attempt was made and he rejected it. I am not an attorney, yada, yada, yada. Just my personal opinion on what I would do in this case.

There are several companies that I have trouble getting paid for my services. I recently just collected on one from July 16, I will take them to collection from now on after 60 days past due. I find it unbelievable to have to wait 30 to 60 days for payment when I do their closing within hours of their call.

It took title company intervention on this one for me to get paid from them. For some amazing reason, he seemed put out that I copied the title company and realtors on the correspondence.

As others have suggested, contact the title company on the deal and let them know that XXX notary farmed the job out to you but has not paid you. Have the file number handy and ask them to confirm that it funded and that XXX notary was paid. Then ask them to contact XXX notary on your behalf. This works wonders when XXX notary's client calls him, embarrassing him to no end. Also cc the loan officer and anyone else that you can find an e-mail trail on from when the docs were sent to you. Usually one of these avenues gets some traction.
I've even contacted the lender on one deadbeat signing service, and the lender ultimately ended up paying me, as the signing service had gone out of business.

This is terrible: this type of post, thank goodness, as only appeared a hand full of times in the 6+ years I have been a notary and posting on this website.
