So I gather this basically says that if they don't pay me and 60 or 90 days out, I discuss this payment with the TC or lender, then they WON'T pay me. Just love the way this industry is going.

I've been collection manager for two days.

Yesterday I contacted a title company - of course the signing service told him that they didn't have my invoice. Alrighty then - I spend several hours completing a closing but don't take the extra 2 minutes required to invoice - oops, I've got a read receipt !!!

Yesterday I e-mailed another signing service (according to their site I should have been paid October 17). They ignored me. I just called and the recording was amazing - all calls will be ignored - you must e-mail them at xxx. They get my phone message and an e-mail at this different e-mail address than was ignored yesterday. Guess who I am contacting this afternoon - title company and broker. Guess who is filing suit the beginning of next week ?

My opinion is that contacting the IRS, BBB, attorney general, etc., is basically a waste of time for collections. Contact their client and if the signing service is still in business, heads should rattle, if not roll. Should anyone ever take their claim to court, can't you imagine the judge's reaction when he hears that we completed the work perfectly but haven't been paid because we 'discussed' it with someone who might actually care about their reputation?

If they breach the contract by not paying you...that discharges you from your obligation to perform under the contract.

This is because the signing service doesn't want any of the above to know that they are only paying you the low-ball $XX fees, but are charging $XXX. I had one SS cry that they were only making $5 on the loan, so I reduced my fee to $60 (back in 2003). I was SOOOO angry when they sent me the invoice for $175 by mistake. I was supposed to e-mailed to the TC.

The SS I work for now are great. A few of them charge substantially more than me, but they are very easy to work with, meet my fees and pay promptly.
