I did a signing yesterday and the Title Co. had a form in there asking for notary information (name, addr, phone#) which I have no problem with, but then underneath that was the wording similar to this...

In case there is a question with any of the notarized certificates, I give permission for (name of Title Co.) to make changes to the notary certificate.

I couldn't believe it when I saw it. I gave my information but I did not sign the form.
Has anybody else come across this?

Who actually authors these forms? Do they not go through a legal process check? HAHA. Barbara, I hope you said something to them about that.

Look at this form that was in a seller pkg I did yesterday

This form appears to be asking me to perform an illegal act and then goes on to inform me that improper notarization are a violation of state law and they will report such violations to the proper authorities. And of course they need my E & O information so they can put in a claim against me.

The wording would also have to be modified. A Florida notary is not authorized to certify that the identification was for some particular purpose. Therefore, any place that said "Notary" would need to be redacted or lined-through. Just signing and not stamping, would still imply that it was a notarial act.

Agree, Paul - and I think many folks let this slide

The ONLY time I let the title "Notary Public" remain/appear by my name is on an actual notarial act. Like Paul said, to allow otherwise is to imply a notarial act.

For all other purposes, I use the title "Signing Agent".

Yes, I've seen the same form, had the same reaction as you (what the ????) and also declined to sign it. Unbelievable! Obviously no clue...

Florida statutes forbid this request

FSA 117.107 - Prohibit Acts

(7) A notary public may not change anything in a written instrument after it has been signed by anyone.
(8) A notary public may not amend a notarial certificate after the notarization is complete.

Once the document is signed, sealed and delivered, it is a done deal. No changes can be made after the fact. Therefore, the notary cannot authorize another person to modify or make changes to any notary certificate completed by a Florida Notary Public.
