OK, the reason I've asked is because...Sorry its long.
Got a call to close a loan yesterday am, EOM. Told the guy that I was checking here for reviews and let him knowI didn't find anything recent. Said we would be paid when loan funded. OK, we'll give you benefit of doubt. Bwr has docs and is very flexible. Well obviously it is EOM, but we have open slot and can do it in about 1 hr. Perfect. This is the second part of closing, wife closed in CA on Sat. He asked if we would just skim through the docs that the wife signed on Sat and make sure there were no issues. OK. new company, we'll do a little extra for them. We get to appt but bring a few individual aknowledgements with just incase. We were at appt for nearly 1 and 1/2 hrs because 1st notary made so many errors, taxes weren't being paid, bwrs name is spelled wrong and 1st notary allowed wife to sign wrong date on all docs and he/she put all the right dates on their own stuff. long story short, it doesn't close. Get a call today at 2pm from Reunion to see if we are available today. Say sure, what time? He says, Not really sure, LO is still working on docs. I say, well we're not on call. Can't wait all day. Thats fine, he says I'll call you back. Calls back about 3pm and asks if we can close in an hour. I say sure. I'll call the bwr. He tells me no, wait 10 mins until he calls me back. Now mind you, I did let him know that we would do it for 4pm because my husband had other things going on tonight. At 4:20pm he calls and says he just sent new docs, and add a print fee to our quoted price. I said "eddie, I told you we could close at 4pm, you never mentioned printing docs, bwr printed his own docs originally. I said, We can't close the loan now. If you want, call another notary or we can close it tomorrow. He says, tomorrow is fine, just backdate docs for the 27th! I said I will not do that, it is illegal! I said, are the docs date sensitive? He tells me no. I said well then we can close tomorrow, but we will be putting tomorrows date on the docs. He says, let me call you back. Needless to say, he never called back. I'd like to know what Notary said yes to backdating! Unbelievable! Sorry this was so long, but this was really the most dis-organized company we have ever dealt with. Just wondering if anybody else that may have worked for them had these issues.

The kind that are criminals, that's who. Others may not approve of this tactic, but I'd wait a bit so the DOT records... then go to the county clerk and pull a copy. Take a look at the date...if it's for yesterday report the notary.
I have no problem ratting out a bad notary if I become aware of one. A trip to the county clerk should be a regular marketing activity anyway, so it's not really time lost if you have a list of past appointments you want to check up with.

Well, maybe I should say tool...rather than marketing itself. I suppose not everyone needs to do it, and I'm probably shooting myself in the foot by saying it.... oh, well. IT's just that since I'm moving to a new area in a couple months, this is something I've been doing lately. I've found it helpful to go the the county clerk/recorder once in awhile and look at recently recorded documents. This gives you all kinds of good potential marketing information, such as the escrow and title companies that are active in the area, as well as other notaries, too. Knowing the "competition" is part of any good business... but also because those notaries could become a source of work, too... especially if you start referring work to them that you are unable to do. This is especially valuable when you know that a notary is working in a particular area...that way you can refer intelligently. But even more, you might be able to tell which companies are using in-house employees versus contracting out. I'll kind of let you figure it out from there. Again, it may not be the right answer for everyone... but for me, it's great because I'm moving to a new area in a couple months and I want to be as prepared as possible once I get there.

You don't know that it was backdated.
Docs are ready, you can't do it today. He asked you to backdate IF you close tomorrow. Maybe they found someone else who can do it same-day -- no backdating involved.

Even if they found another notary, yesterday the 28th,
they still wanted the docs dated for the 27th. That would be considered backdating.

I gotcha. If the doc was notarized the 27th, it would be backdated. However, as long as it's notarized the 28th, there is no way to know for sure if the doc was backdated. They may have found someone on the 28th to notarize. Otherwise, they wanted you to do it on the 29th, but date for the 28th.

Missing something here...
You said you couldn't do it after 4pm on the 27th, but that doesn't mean another notary couldn't.

The original closing with us was on the 27th, but because of all the errors that had to get fixed, they called us again yesterday, the 28th to try and re-sign. Couldn't do it after 4pm on the 28th. Then he said we could close it today, the 29th, but wanted everything dated for the 27th. I know I rammbled alot on the original post. It was just the most frustrating company we had ever worked for.
