lets try this again
I went to get QCD signed for a SS
One of the signers had a very sloppy unrecognizeable signature on drivers license. the signature on the QCD was sloppy but didnt look like what was on DL. when she signed my journal it didnt look like either of the other two. she had no other ID with a signature. clearly the picture on DL was her.
TC said if the picture matches and no sign of tampering with DL it was ok
how would you handle this one?

Why, I would spank that signature and make it go sit in a corner. Bad, bad signature!

Here in VA it's nearly impossible to properly sign your name on the electronic signature pads that the DMV uses. Not only is the pen difficult to sign with, they give you a very small window to fit everything in to. Heaven forbid if you have a long name!

I agree with the title company. We are not the handwriting nor signature police. You properly identified the signer, you watched her sign the documents and your journal, so what's the problem? I don't think MD requires *signatures* to match, only that the *signer* matches the ID.

Signatures change. I've seen them change just during the course of a signing due to fatigue.
I would have scrutinized the DL and if it appeared unaltered, okay.

If the signer is right handed and broke their arm and couldn't sign with their right hand and signed with the left I am sure you wouldn't refuse. Or if both arms were broken and they signed with their foot would you refuse?

I haven't met any borrowers that I'd like to sit with while their feet were up on the table !!! AND, I don't get paid enough money for the time that would take !

I encounter a lot of people who use "scribble" for a signature. As long as I verified their identity & witnessed the signing that's all that matters. Penmanship is not an issue.

In 3 and a half years I just ran into my first situation with a scribble signature being rejected by a lender. On one document mind you. When the docs went back to the audit dept they decided that the signers signature was shortened on this one doc. Signing Service calls me to go to the signers home and get the one doc re-executed. After a little discussion of me trying to explain to them, I cant tell a signer how to do their signature, and I dont believe this is my fault, I tell SS I will go get this one doc re-signed as a favor to them. The only problem being I couldnt take care of it that evening.

In the meantime I receive a phone call from the LO on this loan. Our discussion ended up going nowhere because he was convinced it was my fault and even accused me of not double checking the documents before I left. He was even a little condescending.

Now for the facts on this. The signers signature was a loopy signature and you couldnt make out her name in it. Both the SS and the LO were persistant it was my fault because I didnt catch this when I double checked the documents. The audit dept was convinced the name was shortened and I told both the SS and LO, impossible and heres why. When I called to confirm appt with Elizabeth Doe, I asked her if she went by Elizabeth or Beth. She informed me, Elizabeth. So therefore, why would she sign as Beth? And on the name affidavit, the name Beth didnt exist and she didnt add it. I also hand every signer a document that details to them to sign exactly as their name is printed underneath the signature line, how to do their initials, and how to correct mistakes if we need to. I told all this to both the SS and LO and I still think they are holding me at fault for this.

I am still waiting on payment for this closing and you can rest assured if I am shorted on my fee I will input this info on the NotRot Rating system for the SS. We cannot control how a person does their signature, we can only express to them the importance of signing the docs as their name is printed.
