Interesting assignment
We got a call from a title company about another notary who had missed some notarizations on a signing. They could not contact her (evidently for several days) so we got paid to go bang on the notary's door. Which we did. No one was home so, as instructed, we left docs for them to notarize and send in.
I suspect that's one signing agent who will be getting less business in the future.

What??? You were actually instructed to leave borrowers docs at the home, out in the weather or for anyone to take not knowing if and when they would return especially since they were not able to reach the notary for several days? This is just insane. Why didn't they just pay you to get it fixed? Something doesn't sound right, but then again nothing surprises me anymore.

I think there was a bit of desperation here... and these were more instructions than borrower docs ... left as per instructions.

A really dumb title officer.
And unfortunately a NSA that wasn't thinking either. You just participated in a very dangerous activity. Let's hope the borrower shows up before the package disappears since I don't think your E&O will cover this potentially serious breach of confidentiality.
Next time just let the TC send the package directly by FedEx, UPS, DHL or USPS, etc. That takes you out of the loop.

I wonder if even a general business insurance or umbrella policy would cover such. I would almost bet my life E&O won't cover it unless there was another underlying offense that E&0 would cover, then the E&O would have to cover the entire issue. In particular in also stated with respect to the E&0 carrier having legal counsel represent as the policy holder. I recall reading this in either NAR or NJAR's magazine if Im not mistaken with respect to E&0 insurance. With that said i still dont see where there would be an additional underlying offense that would make E&O cover it. Sorry guys just getting myself in a deep thought and thinking aloud lol

Ralph, I would not have taken part in this boondoggle even for money. What kind of company would leave documents in a situation that they have no idea where this notary is or when she may return. This is more proof of why these companies that continue to hire inexperienced and low paying notaries are finding themselves with half baked packages.

Hope the TC doesn't blame you when they
never get the docs back! That notary could have had a family emergency, be out of town on vacation, could have moved over the weekend. TC should have hired you to do a new closing instead of leave signed docs on someones porch.

What's the difference when FedEx,UPS leaves the package in the borrower's door step? Anybody can steal the package from there too.

I think that if a package service delivers they have a tracking system that shows it was delivered and when and the liability is where? Whereas if an NSA delivers a package and leaves it there is no tracking that it went anywhere?
No clue but as said above, I would have suggested I just go out and fix the prob
what also comes to mind... they know THAT notary will back date the docs to reflect the date orig signed so they want her/him to complete the deal?????

Simple choice
Sue FedEx (or some other common carrier with hundreds of lawyers on staff) for a lost or missing package or sue some poor NSA who has an E&O policy that won't cover delivery services to someone's front door by the Notary because that's not what the E&O insurance is for. In whose shoes would you rather be?

when fedex devlivers....
I make it mandatory that when fedex, ups, and dhl deliver to my home that I must sign or they can not leave the package. The same applies with my office, they can not leave it unless myself or one of my employees sign. We have so much sensitive material in our possesions that if it was received in the wrong hands (ie theif), a client, third party etc. could have identity theft. In this months NJAR magazine identity theft was the main article. It was interesting and made me as a business owner stop and think of my practices and policies.
