My worse experience in Texas
I was called to do one day closing at one Title Company in Plano, Collin County, Tx. I went dress up with my carry on. I found other Notaries well dress as well. The recepcionist was nice and was casual dressed. I met the Office Manager and I was surprised that she and all the office staff were using t-shirts. Was called for the first signing and the office manager said she is coming back with HUD and I should start with the signing. I did the Identification and the Homestead, so far; she entered the room and when asked for the HUD she said that wasnt approved yet !!! That was around 10:30 am. We know Calidornia is 2 hours difference and would be very unlikely that this HUD would be apporved in the next hour. At this point this office manager said "if you - borrower - dont want to sign a form just place is sideways untill the HUD is ready " ???????? The Mr borrower immediately replied " I want to know what is the sales price before going further" Supposely the Real Estate agent was present and he was asked for the sales price, HE DID NOT KNOW ABOUT IT and asked me to look into the folder, no copies of sales contract there. I asked him if he brought his back up copies and he got angry. I stopped the signing and asked the borrowers - husband and wife - to wait outside while the HUD is getting approved. The Mrs borrower make the comment " why they are making the appointment so early when isnt ready? So, they went, all 3 of them to the lobby, and I went back with to the group of Notaries. The office manager showed up and said " you are excused fort he day, please leave." The company which sent there was DocPros, I never before had problems with this company while working in NJ, always paid on time. This particular time, and after talking with the scheduler about what could be my payment on this "signing' which is no pay at all, one the 2 only payments I got for first 2 signings I did for them, WAS RETURNED by the bank. I exactely do not know what is going on on Texas.....but I hope to get the funds for the previous signing I did at borrower location.

Are you saying that they told you they weren't going to pay you for coming in and not being able to complete the signing because they didn't have the package complete yet?

My thought here is that when in someone else's home/office, I am their guest. Their SOP is the rule here. FWIW, I would not have asked the signers/realtor to wait outside the office, unless I was asked to relinquish the office by a staff member. I would have been as gracious and accommodating to the TC's "guests" as humanly possible. I know I don't have all the facts right now, but if the original poster seemed as irritated by the situation as he/she seems here, and removed the client(s) by his/her own decision, I can see the TC saying "we don't need you". It's as if they nicely were saying, "you are not acting as a professional would do in this situation, and we can get along without that". My thoughts are that the realtor (their client) was already irritated with the poster, and the TC wanted to preserve THAT relationship. Since there were so many other NSAs present, who might handle this situation differently, they certainly were able to pick and choose the NSAs who represent them in the fashion they expect. JMHO

From what I can tell you problem it isn't Texas. It is because you worked for a signing service who apparently finds people to work for them whom they think they can do this to. (The SS isn't in Texas, right?)

I agree. This person doesn't seem very experienced. I'm also a little confused, but I think I had heard that purchases had to close at a tc in Texas, correct? Regardless of that fact, it is not unusual docs (especially a final HUD) not to be ready on time. You can blame the ss, but they don't prepare or approve docs, and are just a middleman.

I cannot answer that with certainty. I understand why it would seem that way.
It's the common method. But is it necessary? I don't think it is.
I have made observations that says it is quite okay for title to mail away a package for a loan to a borrower and then they find a notary themselves. But I cannot tell you anything other than I have observed this and have not heard any legal argument or disagreement with it...but I do not know the rule for or against it.

I'm with you Brenda, it is MORE common for a purchase to be done in TC or Attorney's office, but I've got a few realtors "up here" by the lake that often request me to ride along with them (to the city) to do purchase closings. They drive me to the seller to have that part of the transaction signed and then we go to the BO to finish. I guess these are really busy folks or really hungry realtors, but heck! they pay me good, at the end of the ride, and I don't have to use my gas. So, in my experience, TC, Atty's office is needed only for Texas Cash Outs.
I'm a little confused by the original poster's comments. There was a "pool" of NSA's available at this TC office?

I have done many closings in TC offices,
mostly for new home purchases performed in the builder's affiliated TC office. At the end of the month they would call a few local notaries and we would take turns and perform closings one after the other.
Back in 2005, 2006, even 2007 I had so much of this business that the builder ended up being my largest client for those years. One builder still calls me occasionally when they have a busy day or they need someone to fill in for an absent worker. I even do mobile closings for them.
Those were they days...

The only purchases I have ever closed outside of a title company, lender or attorney's office in Texas were one-party signings; either the seller or the purchaser wasn't present.
