POA

I had a title co have a person sign as attorney in fact instead of POA for a purchase thought it had to be POA they argued i did it the way they wanted i couldn't find exact law in the middle of signing

Sorry, but you are incorrect.

As was pointed out, a "Power of Attorney" is a legal document wherein one person, called the PRINCIPAL authorizes another person, called the ATTORNEY-IN-FACT, the power to act on the principal's behalf.

A person is not a POA, so they should never sign John Doe, POA. An Attorney-in-fact is a person with a representative capacity and should sign John Doe, Attorney-in-fact or John Doe, AIF. In states that allow representative capacity to be shown in notarial certificates, the wording typically looks like:

... by John Doe, Attorney-in-fact for Harry Smith ...

The POA is the document that gives

someone the capacity to sign as attorney in fact for another person. Normally the doc would be signed "John Doe by Jane Doe his attorney in fact"

This is the way it was explained to me by a TC. The document is a POA. The signer of the document according to my state's laws would sign Jane Doe for John Doe his AIF. (abbreviation is allowed).

In most cases if you are doing a POA you must place your stamp in the exact middle of the POA's forehead. if you use an embosser you must place it on the POA's left ear. (this if only on the left coast) If the guy is in fact an attorney, just ask him for a date.

well I worked until 9:00 tonight and then went on a date and am now printing paperwork for tomorrow a.m. and then have another date tomorrow. Too tiring for these old bones.

In Illinois, we are required to stamp the POA's butt.
