Recording at the courthouse???

I've got a signing Monday night. Today the title co. called and wants me to record the deed and dead of trust Tuesday morning. I gave them a price to walk it through the courthouse and they agreed to it. Has anyone else done this?? Good and Bad about doing this???

I don't know the procedure there but the first thought I had after reading your post was to make sure you get the title company to sign-off on the Deed and Deed of Trust before you have it recorded.

If you are not taking the pkg back to the tc to review "before" you go to the courthouse, I would fax/email them a copy of these docs and have them physically sign "ok to record" on the Deed (all pages) and the first page, page with legal description, signature page and notary page of the deed of trust

Doesn't the pkg go back for funding first? And isn't there recording fees for each?
I've walked the same thru Maryland it's no problem. Very easy.

Like JK, I'd want it in writing that they give you the go ahead to record AND also that you are recording only, not doing a bring down (updating title). Also, you need to know ahead of time what they expect of you if either document is rejected for some reason - record what's accepted, return both, doctor up and correct an error, front funds out of your pocket, etc.

For a short time, when I closed a loan for GAC, I also recorded the Mortgage after the 3 days - getting someone giving me the go ahead in writing was a HUGE effort so I quit after a few times.

By the way, in my town, if you record at 8:00 a.m. there is never anyone there - the later in the day and the closer to month end the more of a chance to wait in a line. Parking is also easier that early.

Taking docs for recording isn't as simple as it might appear. In my area of VA there are cities instead of counties. Some of the cities require a "cover sheet" for recording Deeds & DOT's.
I've been told that those "cover sheets" have to come from a particular company, and there is a fee for those. Only those who "subscribe" to that can get them (attorneys, tc's, etc.). In Virginia Beach I have taken a Deed in for recording. All you can do is drop in a basket for recording that day, and they can't give you a receipt. I realized after checking into it that it is too complicated & time-consuming. There are even "recording services" companies who handle just that. If you are in one of the smaller counties with a courthouse nearby it might be a different story. As mentioned, you need the checks for the right amount of the recording fees (this is the tc's job, not yours).

It is customary to perform an update of the last title search on the day of recording. The update would be performed down to the hour and minute of the recording of the documents in question. This assures that there are no intervening liens or mortgages recorded since the last title search which would challenge the priority of the mortgage you are recording.

You should ask the title company what provisions have been made to perform the update before you record. My guess is that the answer is none since they have not mentioned it to you. If you are not a title abstractor...do not attempt to do the update yourself.
