After midnight
I had a late night signing in particular where the BOs wanted to sit there and read through EVERYTHING! about 11:30 pm, they asked what happens if the signing goes past midnight. I stayed calm and told them that if it does, I gather up all the paperwork, take it home and shred it because the date will have changed for the rest of the notarizations - they will have to reapply....
It got them moving and we finished with ten minutes to spare.

Re: After midnight
When I go to a closing, if it is after 11 pm, I usually have them sign the RTC and all of the notarized documents first to make sure they are signed before midnight. I then go back to the beginnning and go through all of the other documents.
I also will not backdate, so have lost quite a few signings to those in my area that will. If another company asks you to resign because they did not receive the documents, you do need to sign with the current date (at least the notarized docs and the RTC). If they want anything else dated another than the current date, they can date-stamp those docs before they send it to you. Also, if they date-stamp the notarized docs or RTC with a different date, you will need to correct them.
I am not an attorney; therefore, cannot give legal advice . . . .
