Backdating

Question, I was sent out the other day to have refinance documents signed, now the title
company is asking me to take the mortgage,TIL and right to cancel back out and ask
customer to backdate because the wife name was not on the originals, is this allowed?

NO, you can not back date.

You will need to attach a separate certificate to the mortgage acknowledging the wife's signature.

The other documents do not need notarization, so you don't need to be concerned about them.

While it may be true that the dates on the other docs are not the notary's responsibility, back-dating the RTC is committing fraud. I wouldn't want to be in the position of asking a borrower to do that!

I would not either, Janet. I have been asked to do this before and have turned down the request. A couple of companies actually asked me just to get the documents signed, including the mortgage, but not notarize it and then send the docs back to them. I declined because I will not participate in fraud in any way.
