Stamper, thanx for posting the link. This is great because
it warns consumers. Ilene, your post makes me wonder....if you're turning them down weekly, which notary IS accepting those appointments.

As was pointed out in earlier threads, They are calling using other names in States that have suits against them including cease and desist orders. I got a call from them last week. The members of my network report calls as well.

With all the publicity this and other companies are
getting about scam techniques, it amazes me they still manage to find that one "sucker born in the minute"..
And for all the publicity modifications are getting I can't believe people still don't realize they can get this service for free. Ya think we're maybe crossing the line here into "borrower accountability" territory?

Thanks for the post. The public needs to be warned about these sleeze-ball companies. I made note of the phone nos. for the FTC to report foreclosure rescue & modification scams, as well as the Homeowners HOPE Hotline. Has ANYONE called the FTC # to report that this company is soliciting notaries to aid them in their ploy?????? I'm sure there are many notaries out there that have no clue that this is a scam. It's great that we continue to give the topic coverage here on NotRot. Thanks all.

The FTC is very aware. They are on their initial Operation Loan Lies list twice citing the NC and Ohio suits.

As a notary, I thought I was doing enough by turning down their "notary assignments" and hoping they will go away. But now I see I should be doing more by reporting them to the various agencies listed in the article.

I think that this would be a great story for 60 Minutes, right now! Put these people out of business, not far from Hollywood....let's roll those cameras, get these interviews. I now someone in Santa Barbara who got taken too.

Fantastic idea. How about the person you know from Santa Barbara contacting them. They've done a # of stories on the mortgage mess. There are probably enough people out there to make it worthy of their coverage.

These people were in the Notice of Trustee Sale period (21 days after 90 day Notice of Default period), and this company did definitely still take full advantage with their predatory practices. Loan cannot be modified once it is in this stage, and there was no hope for them, they never received their money back if 21st Century couldn't modify, the homeowners still lost their home. It gives names and functions. They are giving legal advice that is not accurate (UPL)....will be interesting to see what comes of this with 60 minutes. I hope they can jump on it FAST! What about the FBI...I have a special agent friend here in Santa Maria....I'm going to give him a call. What would be worse than 60 minutes in your lobby, how about a cold call from a federal agent.

Maybe we should all send this info to our favorite
tv stations.
They called me on Sat. and the young lady quietly mumbled the name. I simply said, "I'm sorry, I prefer not to work for your company."
what a crappy job to have to ask notaries to work for that company.

The thing about publicity
We talk about it a lot here. The general public does not come here for the news. The media had been slow to pick up on it because it's a fairly new scam and they tend to not notice these things until it becomes real apparent with complaints. Usually to Consumer affairs and State financial dept's. We see it earlier when it first hits. We saw the potential problems with the adjustable rates during the sub prime fiasco as well. An individual contacted by a company is just that. It looks like someone throwing them a life line. There's a very narrow focus going on there. We are in a position to notice these patterns and I guess you have to ask yourself if it smells right. In my mind both personal and notary ethics on reporting possible fraud was a no brainer. It stared with a query of "Is this legal?" to the Dept of Finance.
The one job I did for them, way back at the beginning, was so off, I couldn't ignore it. They had essentially already lost their house with a default judgement weeks before I showed up at the door. Yet they wrote the checks. Just deciding I wasn't going to do those anymore is cop out in my mind. Living with the knowledge that this company continues, blatantly disregarding State laws and doing nothing about it dings my opinion of myself a great deal. I didn't want this to be a regret at the end of my days knowing that I knew and allowed others to be harmed by not speaking up.

Stamper, Excellent post. All very sad and true until the whole mess blows sky high it will not get enough press coverage. 60 minutes sounds like an excellent idea. Think I'll peek at their website and see if they have a press desk area. 60 minutes is always looking for good stories to report on.
When 60 Minutes is in your waiting room you know you're going to have a veryyy bad day.

If you do this too, maybe we'll get someone's attention. I sent the URL of Zana's news article, and said these lies and scams are being committed against fragile borrowers coast to coast, let's see what comes of this. Maybe this will help put 21st Century out of business.
I know they, 21st Century, read this board.

If I may make a suggestion
If your State is not investigating, contact your consumer affairs or financial oversight (they are called different things in different states) and make a complaint. Back it up with any proof you have including copies of the contracts and instructionsof the company if you have them. Black out the consumers name (Confidentiality). My cell records show who is calling me and when. I am concerned they are calling now under a different name.

Perhaps the best place to start is locally - try emailing your states' AG. That's where I'm starting..........enuff local (statewide) emails should get his/her attention.

New Virginia law went into effect July 1, 2009: " Foreclosure Rescues (HB2261/SB1169) Prohibits foreclosure rescue services that receive a fee (i) prior to completion of contracted services, if not involving the sale or transfer of the property, or (ii) prior to settlement if involving the sale or transfer of the property." We can now say officially that it's illegal in Virginia.

Their web page in the CAREERS section says they are hiring! So apparently no one does any research on prospective companies when they're doing a job search.
