just received docs and I see that six signature spaces are already dated 1/29/09. Only one of these docs the HUD/VA addendum to uniform residential loan application is repeated elsewhere in the package and it also has *initial* written on the front. Is this backdating and if so, what do I do?

It's not backdating...have them sign them.

It IS backdating...if they are asking you to NOTARIZE any with the 1/29 date.

It's probably the date the loan was initiated. Not a problem have them signed.

Brother... Backdating 101...

Not your fault, good to ask if you're not sure... so please don't take this as a personal pick-on-ya...but GIMINIY CRICKETS... this is coming up every day. Twice on Sundays...

Folks, it ain't hard...

#1 We only notarize on one day of the week. TODAY. We don't notarize tommorow and we surehell don't notarize yesterday. THATS WHAT BACKDATING IS. If they appear before me on the 28th, my cert says 28, not 27.

simple as pie. No exceptions.

#2 Though it's not our legal responsibility, we need to see todays date on Truth-in-Lending and Right to Cancel. If you let them backdate these, I think you're in a pretty grey area as far as mortgage fraud goes... soot grey, not battleship grey.

#3 Nobody gives a crap about the rest of it. Especially pre-printed dates. If it doesn't bother the borrower, it shouldn't bother you.


As for the 1003... that often has to be dated way back. Nothing to see here, keep moving. In fact, I rarely have the borrower date the thing at all. Never had a problem.


Really, it isn't rocket surgery.

Agreed, the only date I'm concerned with is

the date I fill in when I notarize.

We often have "broker docs" in the packages that will be dated for the date of the application. That's not back-dating as we know it.
