I have been contacted by this company and have decided not to accept any assignments from them. I just don't feel I could sleep at night knowing that this service is FREE at Hud.com and Hopenow.com. I don't judge anyone else who accepts these assignments.

Here is a copy of the agreement that the borrower signs (fees vary -can be more.)

LOAN MITIGATION, MODIFICATION & PRESENTATION FEE ACKNOWLEDGMENT

I understand that 21st Century Legal Services cannot guarantee me any results in the attempt to “Modify” my loan. I agree to cooperate in any way possible to assist its Agents and their efforts to keep my home from being lost in a foreclosure Trustee Sale Auction.

I also understand that I will hold 21st Century Legal Services, its Officers, and its Attorneys completely harmless in the event that my position is too severe to remedy and my home is lost in a Trustee Sales for any reason.
Submission Fee Acknowledgment

A fee of $2,000.00 for the following Service:

· Request adjusting, elimination or repayment plans on any delinquent or past due balances.
· Request Current Status on Credit Report to all three (3) agencies (not guaranteed).
· Request adjusting to current and future rate of interest charge and monthly payments.
· Request loan balance amount to be adjusted if needed due to Loan to Value.
· Request loan to be converted to one longer Fixed Term

The above will be requested and earned upon submission of file to lender. Please make out Cashier’s Check or Money Order to 21st Century Legal Services.

By signing below, I understand and agree that the Loan Modification Submission Fee of $2,000.00 that I elect to pay is being collected exclusively for a formal presentation of my request to modify my loan and is considered earned upon its submission; it does not come with any implied guarantees by 21st Century Legal Services.

Consider this: There is free parking vs. valet parking. You can park your own car and walk or pay someone else to park your car and you're already at the curb. You can walk your own dog, or pay a dog walker to do it. The key here is convenience. There are many instances where you can do something for yourself free or you pay someone else for the service. 21st Century and other companies like theirs offers a service for which people choose to utilize or not. Yes, they can do it for free...but some people just don't have the time, nor do they want to be bothered. JMHO

The Modification Agreement that I attached shows this is only a Request for a modification. To make this Request will cost the borrower $2K or more. In my opinion, this has nothing to do with convenience but companies taking advantage of desperate borrowers. If you are comortable with this and willing to represent yourself as an employee of 21st Century that is your choice. However, I am not comfortable with this and will provide the FREE 1-888-995-4673 number to "Hope Now" to anyone who asks.

None of this is any of your business, nor should it be. You may not be making judgements on others taking the assignment but you are making a judgement as to whether this is good for the borrower. You have no knowledge of the borrowers situation or their needs. It is not your call as to whether they utilize these services. Notaries are defined as DISINTERESTED 3rd parties - which is what you should remain....DISINTERESTED.

I turned down this non notary work and expressed my feelings about it. So, I don't understand why you are having such a problem with this. Maybe you should apply your own standards to yourself. This is a forum and I am allowed to have a different viewpoint. Get over it!

Hopenow is a joke!!!

Granted you can represent yourself in a modification but you are much more likely to be taken advantage of by the lender and their rep's unless you are represented. GET A CLUE!@@@!

and I agree with her and the people who posted messages: #272807, 272823, 272827, and 272818. Take a moment and read these messages. You might change your mind and not be so hostile to others who don't share your views or work ethics.

$2 K is about the going rate for loan mods all over.
If I had a skyrocketing ARM, I would gladly pay an experienced negotiator
the fee to reduce the interest, the principal and have any outstanding late payments
wiped off or tacked on to the back of the loan.
It looks like you don't know what you are writing about.
And, FWIW, if you don't want to hear the opinions of your peers, don't bother posting
to a public forum.
Please, don't work for them, allow someone who comprehends the situation to do the job properly.
Where were you, Claudia, when the sub-primes were being signed? Were you turning down
loans with ARM's? Teaser rates? Not a loan signer then?
It appears you don't understand the whole process, and what a BLESSING it is for some people to pay a pittance to get out from under the weight of a sub-prime mortgage that
continues to accrue. Don't you realize that these folks can't sell their properties because they no longer have enough equity to sell or refinance?
You should be reading, listening, learning and making a living at what you've read, heard and learned.
I haven't read anything from your post that shows these are the bad guys here.

For companies offering "services" such as this, I have a a simple test to determine who the "bad guys" are, and whether I wish to work with them. If they are prepared to make full disclosure to the prospective borrower that the service is available free elsewhere, then I have no qualms about overseeing the execution of their documents. Absent that disclosure, I put them in the same league with companies that offer to help incoming college freshmen find financial help -- a service that is also available free on-line.

Well Claudia, I have done several of these signings for this company and I can sleep at night when I go home for the day. The thing I don't understand is that why won't you represent yourself as one of their representatives? They are hiring you to do a job for them and are the ones paying you, is that not true? This may be a free service on other sites, but there is a bigger chance in having worse problems o line then when you have someone come directly to your home and bring you the paperwork and pick up the documents that the company needs. Of course I have cancellations from clients as I am going to the clients home and I don't complain I just let it go and move on for the day. When it comes to the fee, yes the company is charging the client but keep in mind that this company has attorneys doing the negotiations for the client with their lender and at the end of the process the client not only is brought up current but also gets a low interest rate for 30 years! Thank you for not judging others that take these assignments but we should all just keep our comments to ourselves and let this company be.
