JUST GOT A CALL
from 909-483-1748 from someone who said she was from Fidelity National asking me to do a loan modification. When I told her I do not do them, she hung up. I then checked the number and it is listed to 21st Century. What are they up to now?

Yep, that's the number I have coded in my phone for 21st Century, from my caller ID when they called me a few months back. Thanks for the heads up that they are using a new name.

Me too Frank. I told her there was too much negative press regarding such companies and it wasn't worth the risk. She was actually very polite and said she understood.

They do not want you to perform notary services. They want you because you are a Notary Public and hope that helps their victims believe the scam is legitimate. They'll send you several pages of questions with blank fields in which the answers will be entered later by their rep. Their client is to merely sign the pages, still bearing the blank fields, and you'll send the pages to the company. There's no notarizing!!! A rep will then call the client, ask the questons, and send the pages to the loss mitigation department. I've seen some ads that even tell the home owner who is behind to not spend their money on payments, but to send $1,200 or so to them so they can try to get a refinance at 3%. Keep in mind that the borrower is already behind on payments. The best course of action is for the borrower to call the loss mitigtion department for their lender and ask for help. The same questions will be asked and financial info submitted, and the loss mitigation rep is the person most likely to be able to help. The disclaimer for 21st Century (and perhaps other such rip-off companies) clearly states that their fee is earned upon submitting the information to the lender, that they are not lenders, and that they cannot guarantee any success. It's a total rip-off, as I've told their polite reps three times. They finally quit calling me. If you think you want to work for them, accept an assignment and then carefully look at what they send you. I think your gut feeling will give you a quick wake-up and you'll decline to continue.

Not that it matters but just so you know, this is not necessarily so...the second (and last) assignment I got from them which never went through the homeowner was NOT behind on their payments. It's also been posted that many people are still current on their mortgages but 21st has advised these people to stop paying making their mortgage payments "so they can more easily qualify for the modification"..

They may be doing that because your Attorney General has filed "Civil case alleging violations of the North Carolina Debt Adjusting Law and the North Carolina Unfair and Deceptive Trade Practices Act" on July 13 against 21st Century.

When I first heard from 21st Century Legal Services, as they were called perhaps 10 weeks ago, a fellow real estate broker in Ohio informed me that is one of two companes being sued by the State of Ohio, unfair practises, etc. I'd be ashameed if I had completed an assignment for them.

I doubt they have reaaly changed their name They just don't want the AJ to know they are still working in NC. I doubt Fidelity wants anything to do with them.

I was just going to post the same warning. They called me and represented themselves as Fidelity National. Never sent confirmation or docs, but gave the borrower my name and home number. I did a reverse look up and saw that it was 21st Century and called them and told them I would be reporting their false representation to the NC Attorney General's office and that they'd better schedule someone else to do their loan mod today. These companies are getting very sneaky.

The "operation Loan Lies" list the FTC has has a name and phone # of the contact person for the case at the Attorney Generals office.

I didn't ask the borrower. I just called him back and explained that I chose not to work for 21st Century and that someone else was going to be doing his loan mod.

oh my gosh....I did one of these for an elder man for Fidelity, but I guess that's not who it is either. i had no clue what this was, the man told me that he was told he would get his money back if he didn't get the loan. they have his debit card number, how could i be so stupid??? i got a call from century 21 last night about a loan mod, so i accepted, got the confirm today, no letter head, just looked fishy....so here i am. can i call that poor man and tell him to stop the debit card or something???

My guess is that the cases and orders against them are all fairly new. Obviously, they do not intend to abide by any orders. Guess the State of CA has not caught up with them since they are the ones that oversee their ability to operate as a business.

I read somewhere not so long ago that the State of CA yanked their license to operate....I can't figure out how they're still functioning....but if their bank accounts have been frozen it explains why no one's getting paid!!

All they'll do is have someone who is not obviously associated with 21st, have them form a new corp, new bank accounts, and start the apparent scam all over again. What a fraud!

Looks like the only way to avoid any issues at all is to refuse to do anything BUT the final modification paperwork...10 pages max and no checks collected.

They are now identifying themselves as "Fidelity National Legal Services." They just called me again!!! Must be pretty desperate to get any unsuspecting soul to work for them. I challenged them on the name and they said they just changed it, so BEWARE!!!

The bottom line is...
...these companies will call the job anything BUT a loan mod APPLICATION. These companies will change names like they change underwear... ask them the following questions and you won't be duped.
1. Am I collecting checks from the client? 2. Am I notarizing any signatures? 3. Is the client filling out forms? 4. Am I collecting document copies from the client (i.e., ID, mortgage pymt coupons, utility bills)
If you ask those questions and the answers are YES to at lease three of the four questions, you will KNOW that you are being hired for a loan mod APPLICATION. If the answer is NO to all of the questions, but the paperwork says otherwise, then you'll KNOW you were deceived. In either case you can turn down (or give back) the job.
