Seeing Double

TRUE OR FALSE: If you affix an ink seal to a document and it is smudged or blurry, you may not affix a second ink seal impression.

ANSWER: False. If the first seal impression isn’t readable, you are permitted to affix a second seal impression near the first one. However, it is important that neither seal impression obscure any text on the document.

If there is no room for a second seal impression, the Notary should attach and use a loose certificate instead. In either case, the Notary should make a note of the circumstances in the journal entry.

While this is true, if and only if, the second impression is made at the time of the notarization. In Florida, and possibly other states (consult your own state handbook and/or statutes), once the document has been executed, notarized and returned, the notarial act would need to be completely re-done. In other words, the document would need to be notarized again, in the presence of the signer(s) who may or may not need to sign the document again. [Ref: Florida Governor's Reference Manual for Notaries, ed. 2001, pg 29; F.S. §117.107(8)]

Can't believe I'm gonna defend the NNA

I think the point of the question is to point out that a notary CAN stamp the same doc a second time if the first stamp is defective as opposed to having to redraft and resign an entire new document.

One more reason I won't be renewing. There are quite a few other areas they give misinformation. Not every company is going to have all of the laws right for every state; however, the injustice they are doing to us as notaries outweighs the benefits.

As far as the double stamping--I would just swap out the original for the borrower's copy and re-do it on the spot.

Which is why I said the info was incomplete. They did not say this could only be done at the time of the original notarization. I have had a few occasions where I put an "x" through an incomplete stamping & stamped again. I've been told there is absolutely nothing wrong with doing that, as long as you "x" out the first stamp.

I have an embosser...think I've used it once in 3 years...
