signature name affidavit
I got a call tonight for a closing I did on the 16th. Was told that they signed wrong. That this has held up funding. But, after so long?
Do you have the borrowers sign next to the aka's? I always have but this one wants it differently.

Lenders and title companies have so many different ways they want a SNA executed that you can be wrong no matter what the borrowers did. It's a C*ap Shoot that sometimes you win, and sometimes you don't.
It's a shame that the title company took so long to discover the "mistake", so perhaps it might have something to do with rising rates, but that's just a guess on my part.
Always check your instructions carefully, although that may not have made any difference.

I just can't believe it took so long to get back to me. And, that this hasn't funded yet. They signed on the 16th. And, do you have them sign next to their aka name? I have always had them sign the way it shows there too. And, what is not their name I have them write I have never been known by this name.

Like David said, different TC's & SS's want it different ways. If they included a signature line next to each AKA then yes. If it is a Bank of America that only has one sig line and lists all the aka's below, then no. JP Morgan Chase has got their own strange SNA that usually commes with 5or6 pages of examples/instructions. Without knowing what lender you are referencing it is hard to know.
It really varies from one SNA to another and one company to another.
Did you ask them to fax/email a copy of what you did wrong? I sure would.
Good luck and do not get discouraged about it, mistakes happen to even the best of the best...not putting myself in that category for sure. lol

Never heard of a Signature Affidavit holding up
funding..did you check to see if your security instrument recorded? This may be a creative way to get out of paying you for a return trip - I'd check on that security instrument..if it's recorded then the loan funded...and I'd ask for a return visit fee.

They did send me a copy of the original. It is a BOA. I had the borrowers sign next to all the aka's there were four. But, forget to have her sign on the top. I always have them sign next to all of the aka's . None of the name affidavits that I have had looked like they should sign next to the aka. The line wasn't separated like the top one. They have asked me to just have them sign the top line.

Ali, just curious what name you used in the ack. if they only signed the AKA's and not the vested name?
B of A's name aff. is only signed up top accross from the name that is used through the whole package... all the aka's are listed below but have no signature line next to them. By them signing above they are stating that, yes those other names do apply to them. If they do not then I have them cross through it, initial it and write a short explanation like never been known by Daffi D Duck.
I still do not think this doc would hold up funding, but stranger things have happened.

you did forget a signature, and you will have to fix it. That's the business. As for the a/k/a's, if there is no line next to them, I do not have them sign all of the a/k/a's. If I'm not mistaken the Signature Name Affidavit used to have lines next to all the aka's, but they've changed that. I just have them sign if there is a line next to them. MHO
