need feedback.....
Lender sends a blank acknowledgement with docs. I send it back blank with signed and completed docs. It wasn't necessary for me to use. now i get email from ss, saying lender requires this to be filled out and i need to get one faxed to them. thoughts?

Re: No way! No telling what would happen if you did send one.
I sent an email and asked what doc I forgot to notarize and that I can't just send a blank one. so please verify. he sent back "just send them one, they need it right away".. what?

& its an "all purpose acknowledgement" which WA doesn't use
we use "individual"

Do as you did, however, put PostIt on Cert. saying "no doc/signatures to notarize". So far/so good. At least they know you weren't born yesterday.

That's actually illegal for us to do here in FL..
Fl Statute 117.107(3) "A notary public may not affix his or her signature to a blank form of affidavit or certificate of acknowledgment and deliver that form to another person with the intent that it be used as an affidavit or acknowledgment"
You can send a blank one, Rhonda...a BLANK one...no signature or anything...BLANK....

Never!
All notarizations are supposed to be attached to a document with the signature(s) you are notarizing. Read the notary laws for your state. Your E & O insurance wouldn't even help you if an unscrupulous title agent attaches that extra notarization to a document you or the borrowers never saw.

If I can tell what document it goes with I print the title of that document across the top, the date and any other identifying information about the document. Occasionally a document prints across two pages and the Ack goes onto the next one.
But if it's just a blank one laying in there I don't even send it back! Let them call ME and ask for a (illegal in my opinion) naked Ack and explain themselves. So far no calls (doesn't happen often) so I think they don't even notice. They just think they need insurance to cover their a's but I won't be a party to it myself.

I was told by one TC that does this that that is the reason. Like Gary, I just pull from the package and that's the end of it.

this is the kind of feedback that is helpful. that is what i will ALWAYS do now. i've done that before lots of times. just didn't really think about it with this set.

I know a lot of Countrywide packages had an extra acknowledgment in them. I always pulled it and never used it or sent it back with the documents. If I had to use a loose certificate I used my own so that I could fill out the optional information which indicated the title of the document, date of the document, number of pages in the document etc. This helps to keep the document from being attached to another that isn't recorded in my journal.
Oh yeah, it's illegal to do what they ask, and it's illegal for them to ask me to perform illegally.
